Bargain priced petrol

On my way down to Lostwithiel the other day I passed a local petrol station selling both petrol and diesel. The prices advertised were as follows:

DIESEL 132
UNLEADED 11.9

It was an old sign clearly not geared to take todays petrol prices - I suspect the price for unleaded was actually 119p a litre. But the sign was clear - diesel was '132p' (No decimals) and petrol was '11.9p' with a decimal.

I wonder, legally, what would happen if you filled up and then queried the price :D
 
contract law states that the price advertised is an offer

there is no contract until you go to pay

i could advertise in a shop that mars bar is 30p but actually charge 50p at the till

I quite agree but in the case of petrol retail, the goods have already been consumed at the time of payment - the petrol is in the tank.

Invitation to treat etc is also different at a restuarant - it's unacceptable to expect the contract only to be formed at the time of payment, after consumption of the service.
 
Heh, drove past an old fuel station just after Tern Hill last night.. and had to laugh at how all the prices were under a pound.... :(
 
I don't care about how much it cost back in the day, go cry about that in the stupid 15 page long 'omg it costs the moneyz' thread :p

the petrol may be in your tank - but it isnt yours until you pay for it

same as for goods in your shopping trolley - they arent yours until payed for

they could ask you for their petrol back and you would be obliged to give it back

edit: I'd say no you probably couldn't get away with it as it displays the prices on the pumps etc too?

It's slightly different from that, food is after consumption whereas fuel is on delivery but before consumption. Using the restaurant analogy you'd come back after you've used the fuel and pay then.

But I do agree that it would be quite awkward! I don't see how they'd arrange to get their petrol back.

Not really, no.



And how do you suggest you'd go about doing that?

you could cut a hole in your tank for all i care - but it stands - you would have to pay whatever price they asked - if you didnt they could ask for their petrol back and you would have to do so otherwise they could just phone the police
 
I think petrol is closer to the restaurant example than it is to the supermarket one - you can put shopping back as if you'd never had it but even if you managed to syphon £80 of petrol from your tank where would you syphon it to? They'd presumably be unwilling to put it back into the main tank!
