Do I have a case to fight this parking ticket? Photos included.

So the arguement is "because theyre doing it im going to do it too", nothing will ever change if people take this attitude. Fair enough if something has been given unfairly then appeal it, but the OP knows hes wrong, he should man up and take it.

The authorities are meant to be setting an example and enforcing regulations fairly: they're the ones dishing out the fines therefore the burden is on them to get everything right. It seems utterly ridiculous that we should just bend over and pay up when they can't even be bothered to look after their side of the deal and maintain street markings.

The more people who appeal, the more they will be inconvenienced, therefore they will make much more of an effort to ensure everything is fair and correct. So, in a way, we should be setting them an example by appealing tickets that don't conform to regulations.
 
Whilst the lines are in poor condition, it's kinda obvious that they're meant to be double yellow lines and you shouldn't be parking there. No case to appeal.

If however there were properly painted markings elsewhere along the road then you could argue it as you thought these lines were deliberately old/removed, as otherwise they'd have repainted these lines when doing the other good condition ones in the road.
 
Make no mistake, you'd get off that in a shot if you appeal, the lines must be unbroken to their point of termination, those clearly are not.

However, as before, from a moral standpoint it was obvious you were in the wrong and it's a shame as a society people would rather do something they know is wrong and exploit a technicality to avoid taking responsibility for it.
 
Absolutely appeal, you may end up having to force it to the adjudicator, for the council to drop it the day before your case, but I'd go for it!
In future, take any ticket, council or private parking company speculative invoice, to www.pepipoo.com, where they're happy to help fight, morals aside.

A double yellow line with a gap obviously bigger than a slight crack is not legitimate.

Whether the line is clearly visibly, you'd have to be a right tard to say I didn't' see the yellow lines or that I wasn't parked too close to a junction. Posting the picture is the nail in the coffin I'm afraid... but hey ho, give it a whirl rofl
 
I do hope all the morality captains posting here are as stringent with their morals in other aspects of their lives and obeying laws, speed limits for example.

You make the mistake of thinking those of commenting claim to lead a perfect life - we don't, we just have the backbone to deal with our transgressions if and when we get caught, not try and wriggle out of behaving like a responsible adult on technicalities.

I see, so it's okay to break the law as long as you accept the consequences if caught, may I ask what other laws you apply the same logic?

He doesn't have to, if the council wish to apply parking restrictions to that section of the highway then it is up to them to maintain the road and markings in compliance with the regulations.

But in the same scenario by exploiting the technicality, one would hope that it would prompt the council to get the lines repainted so that it no longer happens.

Sometimes the council need a kick up the bum to get things done just like us normal folk do :)
 
Well I contested it and a week later had a letter come through saying they cancelled the PCN and closed the case.

They said although the road markings were good enough as it was my first offence they would let me off.

Not sure if that is the real reason they cancelled it or it was really that I did have a case but either way filling out a 5 min online forum saved me £35.

Thanks for all the advice that was given both for and against fighting it.
