my findings so far, with sapphire r9 290's

batman arkham origins = stutter fest single, crossfire,
assassins creed 4 = stutter fest single, crossfire,
saints row iv = stutter fest in crossfire but plays smooth with single card
witcher 2 = good performance in crossfire

all i have done is enabled crossfire in ccc
am i doing something wrong do i need to enable something more or use a 3rd party software?
the gpu is usage is up and down in after burner like crazy

Make sure your using the 13.11 beta 9.2 drivers.

Saints row iv should really smooth, it does for me using 2 280x's so it should in theory run better for you.

You shouldn't have any problems at all. AC4 is brand new, almost a tech demo for nvidia proprietary features and a total mess in performance. Batman AO shouldn't be too bad, but I get stutters on 670 SLI even though the GPUs aren't even at their max clocks.

Try some games that definitely scale well and have good driver support if you have them. e.g. Sleeping Dogs, Tomb Raider, Bioshock Infinite.

Hopefully just teething problems with the games and drivers then. Saint's Row IV should be fine as it's an AMD title, but then the 290s are new and will still need a few more driver updates before they're ideal.

Out of interest are you using stock 290's or have you put them under water? I'd love a pair but I need a grahics solution now not next year so have been reluctantly lookng at a pair of evga classifieds.

stock gpu's ordering blocks tomorrow payday :D, evga classifieds are good nvida cards i would reach out to say there the best in my experience "i remember my classifieds hydro copper"
gtx 8 series will be my return to the green team i will rotate yearly to see what both sides of the water can do
