Advice on consumer rights and email to garage...

Do you really think a small garage has a legal advisor on call? He's just stalling so you lapse past the 30 days. The dealer's legal obligations are simple, he will know them well given he works in the industry and it just trying to play the system.

Just respond you are not prepared to wait and are therefore formally rejecting the car, send a copybook recorded delivery and be done with it.

Probably not, but my brothers a solicitor so if it goes down that route, I do have one on standby if need be. I intend to reply along the lines of no problem but I expect a reply within a reasonable timeframe (Which I see as COP tomorrow) if nothing then I will chase and then send letter Friday evening.

Him waiting won't matter as the point was raised inside the 30 days. His delays mean nothing in legal terms.

Reasonable time frame would typically be longer than one working day. Perhaps more like 1-2 working weeks.
 
Get your brother to write a letter to the garage requesting a refund and send it recorded.

That should put the willies up the dealer and his 'legal advisor'.

Not when they have to refund me for the car, I should be able to drive into the garage for an instant refund. They should know how it works as a seller so I am unwilling to wait any timeframe like that.

That's what I will do, if they don't come back fast.
 
One thing I can advise is if you are going down the route, I'd personally send a signed/recorded letter to them informing them of the fact. At that point, you've got /proofable/ evidence that you've contacted them about this. (And for the cost of a couple of quid, most likely worth it in the long run).
 
My concern would be, what are you going to do when they "fix" the fault, only for it to come back after your 30 day refund window has passed?

They've shown they clearly have no interest in sorting it out, and while i know you've said there aren't many 1.9 puntos around, it's hardly a "special" car and i'm sure there are plenty of alternatives local to you.

At this point all you've got to lose is a couple of hours driving and 160 miles worth of petrol - the issue of putting 160 miles on your car is barely worth even considering (and regardless you'll have to make that trip whether you're rejecting the car or having them "repair" it).

If they bodge the repair (which given the responses so far sounds very likely) and then a few months down the line the bodge fails, you'll be in a much worse position

Chances are they'll offer a refund, not do a thing to it and sell it on to someone else in the hope that they're less expecting/demanding/knowledgeable of their rights and try and fob them off.

Im surprised nobody has noticed that he bought the car from a dealer in Bradford.

Never buy a car from that area.
