Well that's obvious - why would you want to do that?

Essentially you're happy to scam people?

I've not been able to get through all these nonsense replies. What a forum, hey. You should have posted this straight into motors man.

What this guy has done is illegal. It is dangerous. Report him, provide the evidence from the original owner, get a reference and call you CC company providing that reference.

You should get your money back, and he should be investigated.

OP have you actually inspected the car to see if this issue you are worrying about even exists?

I received a PM from an individual telling me they had sold the car less than two weeks ago as spares or repair due to the car being structurally unsafe.

He then sent me photos of the underneath of the car with a quote from a specialist totalling to nearly £4000.

Apologies if it's been discussed but it was either insanely cheap or special to buy it without looking from the other side of the country.

This nearly happened to me years ago. I was young and inexperienced and found a Saxo VTR on eBay, won the bid and went with my stepdad to pick it up. Luckily my stepdad was quite experienced in buying and selling cars and quickly pointed out that the car looked like it had been in an accident.

As soon as it was pointed out we walked away. If it wasn’t for my stepdad I probably would have brought it.

To me, this is one of the core problems and is why the OP needs to get some professional advice.

Presumably, the person who sold the car to the OP is denying all knowledge that it's not roadworthy and will continue to do so. Furthermore because the OP paid through a third party agent (Paypal) not directly through his CC, he's probably not covered under section 75, in the same way he would have been if he'd paid directly.

The bottom line, is that the seller is committing fraud, by knowingly selling un-roadworthy cars, as roadworthy cars to unsuspecting buyers. However the OP will need to prove it in court.

If the original seller (the guy who legitimately sold it for spares and repairs) is willing to be a witness in court, it could sail through - if not... Could me a major pain in the ass.

Either way, OP needs legal advice.

You’ll get your money back through the CC company. They’ll ask for all the evidence which you have.

He probably won't, because he entered his credit card into Paypal, and paid via Paypal - so he didn't actually pay with his CC, he paid via Paypal, so he loses the part of the consumer credit act (sect 75) which gives you the right to a refund if you're scammed. (Paypal has no buyer protection for buying used cars).

It's basically a black hole, because you'd think you'd be covered by either the CC or Paypal, but in reality you're probably not (in the case of used cars)

As far as I can tell, the only possible recourse for the OP to get his money back, is to take the seller to court.

However, there's a chance that if he gets a solicitor to send a strongly worded letter before action to the seller, that he caves in and coughs the money back up.

You say you have photos of the underside , are they your photos or from the gumtree add.
Maybe the guy bought it as spares or repair and has repaired it , specialist might have wanted £4k to repair it but a handy mechanic might have been able to fix it for a few quid.
