It's utterly ridiculous tbh. 3 weeks since having an offer accepted and still waiting for draft contracts from the seller.

You've got no choice really but to keep looking, and be ready to ditch your seller for something else if it comes up with no/less chain in the way.

Hugely frustrating experience, let along the 700 quid or so I have to drop on a survey without any commitment to the sale. It's utterly ridiculous that the seller isn't responsible for getting an independent survey.

At this stage I'm ready to cut losses myself.

Ended up emailing my sellers solicitors yesterday, to see if I could light a fire. Seemed to have worked as my solicitor called first thing asking why I'd done that :p

Told her it had had the desired effect given they had not gave me an update (despite calls and chasing) in the last 10 days.

Emailed the sellers solicitors again to say thanks for getting in touch with my solicitors its appreciated, just to wind them up a bit further. Not like it can go any slower and I need some relief.

Still delayed as an existing Land Charge (c1) relating to a paid off second mortgage in 2000 is registered. Apparently because it's no longer mortgaged it's proving impossible to get the ex lender to remove. Shame we can't bill those tossers for wasting everyone's time.

Due to complete tomorrow. Feel sick as expect it to go wrong somehow.

We actually nearly fell through today as our buyer (a relative) got a surprise bill from their Social Landlord on the the Shared Ownership scheme asking for 2 months rent up front in order to complete at 16:15 this afternoon with money due before tomorrow. This was never discussed or put in contract from what they have said in the pre-exchange docs. They didn't have the money. Thankfully as its a relative we were happy to cover it for them. If it was a random buyer then I don't know what would have happened. People buying Shared Ownership don't tend to have a lot of money kicking around spare especially when leaving a fully rented property.

Here is hoping no more surprises tomorrow! House is packed and collecting van at 10am...

Does anyone have any experience of this? Apparantly the challenge is the ex lender are not taking any accountability and keep asking for evidence of this charge and that it's been paid off, which has been supplied by sellers solicitor. Not entirely sure why it's dragging on - our solicitor said it's to do with the property being unregistered... ?!

If the lender who apparently have this charged logged agree to removing it... does anyone have any experience on how long this takes?

Obviously asked my solicitor but they weren't helpful, just said it's out of their hands and it could be weeks or months. :rolleyes:

Yeah unfortunately old charges can be a right pain to sort out.

Have 2 at the moment that are proving impossible (I'm on the seller side so buyers are furious at me obviously :rolleyes: but nothing I can do). One is in favour of HMRC from the mid 90s. Court that made the judgment is closed. Solicitors that applied for the charge in favour of HMRC are closed. HMRC cant find any records of it. So all we know is HMRC are owed money but until we find out who to pay it to and who will remove the charge we're ******.

Next one is a normal lender but similar issue.

As to your one, being unregistered shouldn't really matter as its still a case of sending a discharge document to the land registry which wouldn't take long. But if the lender isn't playing ball for some reason it could be tough.

No further communication today so have just emailed the EA and solicitor and said we'll be pulling out of chain unless we get something definitive by Friday.

The lender is still in business very well known and I fail to see why the sellers solicitors (or sellers) can't complain or escalate this. They specialise in OAP and they're basically putting a very old couples down size to a bungalow at risk. If it was me, I'd be sticking it on social media.

Anyway, if I've not said it's moving house sucks, how this thing even works 5% of the time is beyond me. I received some ridiculous deeds from the 1920 that were unreadable.

Only came up in a chance conversation this evening (she did not know who our sellers solicitors were). Turns out the convayencer works in the same building she does. She's going to go and stand by her desk tomorrow morning and try and push this!

Excellent news! Although if its the lender thats the problem it may not help, don't get your hopes up too much. Conveyancers may seem useless (admittedly a lot are) but they aren't always to blame for delays ;) just the easiest to blame!

Interesting, not many unregistered properties in England these days. Still pretty common in Wales though.

It's an old house from 1920, it last changed hands in 1975 and I don't think registration was forced until the early 2000s?

Agreed on it not always being the convayencers fault, and I don't think it is in our case. However someone should be able to put pressure on the lenders. If I was the seller (not solicitor) - I'd be causing hell for them. Given I can't do that, I need somebody else too. Shaming them on social media seems to be the best way to expedite! Plus we need somewhere to vent :D

It is criminal that they can cause this level of disruption to people's lives. The request to remove the charge dates back to early November 2019!

Well completion day is over. In and unpacking tomorrow. It’s been a crazy day. Completed by 11:30 and got the keys just after lunch. Taken 6 hours. 3 Luton Van trips and 7 trips in 7 seat SUVs go get everything moved.

doing it ourselves was certainly cheaper but I now understand why people pay others. I ache and have days left to go!

At least it’s over. Pics to follow tomorrow.

doing it ourselves was certainly cheaper but I now understand why people pay others. I ache and have days left to go!

Lucky I don't have that much stuff But I have a van trip to Suffolk from Cardiff and back at stored stuff at my parents.

Doing it myself this time as we have 3 weeks to move with rent overlap but never again!

Oh I hope we made right decision lol. Woke up today with aches in aches. Heating wasn’t programmed so it’s about 6C indoors. It’s works though so heating up now. Trying to get kids off to school and then will start the rest.

the sheer size of this project is dawning in me though. There is so much to do.

It's surprising how a 3 week overlap can vanish very quickly.

When we purchased ours it was all very rushed at the end, so we pretty much exchanged and completed within 2/3 days, but that gave us about 3 weeks left of the flat we were renting.

By the time i started tearing some of the rooms apart to paint walls and ceiling, ripped off the old skirting board and pulled up the carpet, those 3 weeks just vanished.
