I've had some nightmares with my new 6970 too.
Somehow it's giving me less FPS in F1 2010 than the card it replaced, a 6850. And some benchmarks in iRacing are also slower. Very odd stuff going on.
Sapphire does like you say and I believe PowerColor "probably" does - reviews show that it is included in the box, but the PowerColor website has (optional) after it, so its inclusion cannot be 100% guaranteed.
XFX definitely don't include it, as is the case for HIS.

My last card (4870x2 running Cat 9.9's) was able to apply AA to any game running in window mode (this was how I used to take screenshots for things like http://www.youtube.com/watch?v=qx3RClNkdtE).
Installed a 6850 this week, installed Cat 10.10's and absolutely cannot get AA applied...
It's weird reading threads like this. When someone says 'my first PC was a 486 DX2/66' my first emotion is jealousy! I'm conditioned to forever think that spec is godly, as it was when I was getting into this stuff. My 386sx40 was just so much slower it hurt.
