Is there a big problem with either on these drives just been reading up about one for sale and there were a lot of people asking about which drive it had?

I think BenQ is quieter (in general). But people usually ask about specific drives as certain drives are easier to make play pirated games on your 360 etc. Unlikely they are asking for noise reasons as some BenQ drives are louder than Lite-on (it's a bit hit and miss).

oh ok, I wondered if they were more likely to fail or something, I', looking to buy a new Elite so wanted the info before I purchased. Thank you :)

Could you swap a liteon for a benq if you saw it for sale?

Not really it's not a simple swap, AFAIK each individual drive's logic board is flashed to only work with that particular motherboard in each 360. So that pretty much means you have to swap to the same brand same model optical drive and swap the board over to the new drive for it to work. Not sure if it's still the case with the latest models though.

And as said removing the case is difficult enough let alone doing it without voiding the warranty seal (possible but there's always a risk).

Ive got a benq drive in my 360 elite and in my old refurbished premium, both pretty damn noisy, I dont recall my old launch console being much quiter though (IIRC it was a tosh drive)
