Accident - fault question

Driver 1 : person with misleading signal
Driver 2 : Person who pulled out of side road

It will probably go 100% in favour of Driver 1

If 'Driver 2' has a witness to support that 'Driver 1' had a misleading signal then it will settle 1/3rd 2/3rd split in favour of 'Driver 1'

This is exactly what happened to me, only put me in the van drivers position. I've been told both by the police and by the insurance that there is categorically no chance that it would go 50/50, regardless of any indicators.

So this went against you then, as the person pulling into oncoming traffic?
