Advice on speeding please!

Ok, friend of mines car was snapped by a camera van back in May. He received the NIP but really doesnt know who was driving.

He sent off within the 28 day period for a photo of the alleged crime and has received it today.

Its completely impossible to distinguish who is driving the car...and I mean, completely....

What should he do now?
 
Not good enough i'm afraid!

He was selling the car and had about 5 test drives that day! Hows he supposed to know who was driving let alone how to get in touch with them!

According to the website, he needs to provide a list of possible drivers to the police & may receive a letter like this.

And also;

(4) A person shall not be guilty of an offence by virtue of paragraph (a) of subsection (2) above if he shows that he did not know and could not with reasonable diligence have ascertained who the driver of the vehicle was.
 
he wont get done for it, police will write to the possibles. It gets tried on a lot, and if you get caught trying it on your in big trouble.
but if they dont find out/cant tell who it wasthen they can't do you.

Where is this from and more importantly what does subsection 2 say?

A colleague of mine was in a similar position, between his wife and him, and they got off completely after not being able to prove who was driving.

same with a bloke I work with

if you can prove that you have undertaken "due diligence" in trying to ascertain the driver then you cannot be convicted ( in theory :p )

Hes Mute and has no arms or legs so would have to type with his nose.

Hence the reason the car was on an unaccompanied test drive.... ;) :p
