Another ebay thread. case awareded in buyers favour. I really have no idea how!

how do i prove he is holding some of the phones. i know i posted them as i have no intrest in holding back faulty phones as i sold them all as faulty

You said you'd got the IMEI numbers, right? Yes, I know they can be changed. Of course, he could try to pull the same trick with the Police.

I can think of other options, but they might be construed as fraud so that's as far as I'll go (to remain within the forum rules).

Right, here's me being a mischievous so and so, having started out railing at you... If you know which phones he is claiming to have, you could always report the other ones as stolen and get the IMEIs blocked.

i will do but ive still lost out though:( no woirres about the railing :)

Sounds like one of those blokes who knows how to play the 'bay, the seller protection on there is woeful at best of times. Decisions are usually final with them but could still try, was this a dispute open with ebay or paypal (if you used it)?

opened with ebay. with paypal at least you can email them directly regarding a case

Honestly, I dont know why people still sell things on Ebay. Every single thread on here, on a weekly basis, is the same story.
 
The weight of the phones should be on your receipt. You should be able to compare the weight of the returned phones.

To be honest though sympathy when you mentioned that you inflated your prices for your fees :rolleyes:
 
found the recipet :). Do you think ebay will change their mind. If he only does post 6 phones back then it weigh a lot less than before

Could always video or take pictures with the unopened package showing the weight and then opening it and showing what is inside etc for ebay to review. To be honest it doesnt sound like they reviewed the case at all first time around but this could be a waste of time. Worth a you tube video for OCUK to watch though :p

He has to send the phones to ebay... Not you (i believe) and then when they get them they release the fees that are currently in holding. I had this happen to me, but the buyer did not ever send the ipod back to ebay and the case was reversed back to me.

really? in the ebay case it says my address has been given to him so he can return the phones

Correct, but he's now stated he bought the box for £1.50 so it works out.

What? It goes straight back to the seller, certainly not to eBay in my experience.

This is a great idea. I'd stop with the eBay route, and once you've received the phones back, email him pointing out out the disparity in the weight and that your next steps will be filing a small claims recovery action and contacting the plod notifying it as fraud unless he pays the amount due, or returns the other phones.

If he does agree, forward the email from him to eBay to try to get his account suspended.
 
This thread reminds me that ebay is not worth when selling certain items. I still use it when buying/selling games etc and never had any issues and I've got over 240 positive feedbacks now.
