Auction place - Lazy Seller - question

Opinion needed.

1. I bid on an item, ask the seller a couple of questions
2. Seller ignores my questions.
3. I win the item.
4. I wait with payment and ask some more questions, seller still ignores.
5. I pay for the item.
6. 2-3 weeks later i still don't receive the item, i start emailing the seller again
7. only reply i get to my 7 emails is "I get 200 emails a day" no real reply to my questions.
8. I file a dispute with Paypal
9. Seller finally emails me, saying the item is delivered at my address and signed for.
10. I post back informing i never received it, and escalate the dispute to a claim.

Now the seller is getting desparate trying to contact me, requesting my phone details, emailing asking for my correct phonenumber.

I tell him he has 2 options:
1. He refunds me the money, I will cancel my claim and write him a letter stating i haven't received the item
2. We let PP handle the claim settlement

He keeps emailing me asking for my phonenumber to discuss, i can't be bothered as i'm at work and rather email.

Today the seller emails me that the item has been delivered to another house in my street ?!?! And that the delivery company is going to recover it, then deliver it to my address....

point is - it's been over 3 weeks now and i rather have my money back. I told the seller this, he's ignoring me again now. I don't want the item anymore...

Q: will Paypal sort this out and will I get my money back?

If the item does get delivered to you, and the seller can verify that to Paypal, then you will NOT get a refund.

trojan - why post if you are not interested? If you don't have anything useful or positive to say, then don't post!!

Thats where you went wrong i'm afraid. If the seller can't be bothered to answer the question of a prospective customer to get their money then aftersales service isn't exactly going to be a top priority.

Whether or not I wasn't 100% with the item is irrelevant - the item has not been delivered that is the problem. Seller doesn't want to communicate.

You said that there was a delivery error though, and that the seller was going to get it picked up and redelivered to you. If that does happen, then as far as Paypal are concerned the seller would have fullfilled his obligations.

If that would happen as you describe, then yes. But ofcourse then the matter remains of the high delivery price paid on the item - that i would want to claim back ofcourse!!
 
Next time get your answers before you bid on an item.

Delivery error is not the seller's fault and he has already told you he is getting the item recovered and redelivered. As far as PayPal will be concerned there is no claim - unless the goods aren't as described but that is a different issue.

You just want your money back because you're annoyed with the seller.

Correction: Delivery problems ARE the responsibility of the Seller.

I have still NOT received the item, that is my first problem.

My second problem is that I paid £8.50 for delivery, so I expect that to be next-day, not 3+ weeks.

My third problem is that by now I'm not so much care anymore if it is going to be delivered or not. I'm happy with my money back, or have the item with a refund of the delivery costs.
 
The delivery man taking it to the wrong house is entirely out of the seller's control. He has also told you he has or is sorting the issue and having it redelivered.

£8.50 may well be next day delivery. That has no bearing on WHEN he posts the item ;)

Yes this seller is clearly a **** but you shouldn't have bid then asked questions. If you'd asked first you might have known he was an ignorant git and decided to look elsewhere.

Again, from Paypal's perspective it's not going to happen. They will state that it's a private matter between the selling and purchasing parties.
 
I hear ya SirusB - seller is indeed trying to sort it out. Still the delivery company made a mistake and should refund the delivery costs. This is what I would do, if I had posted the item and someone would have to wait 3+ weeks. That's if the item arrives....
 
Still no luck. I got this message from the seller yesterday:

THE WOMAN AT NO XX HAS TOLD US THAT SHE HAS JUST BEEN AT YOUR DOOR AND NOBODY ANSWERED SHE ALSO SAID SHE KNOWS YOU AND SAID THAT YOU HAVE A HEARING PROBLEM WOULD THAT BE RIGHT?

Is this guy taking the **** out of me or what? I have not received any parcel, he's now on "ignore" mode again I think after i told him that I won't cancel my claim until i either have received the item or a full refund.
 
What delivery method was used? The seller needs to provide PayPal with the online tracking number. If he can't do that, you will automatically get a refund. This is assuming that the auction was covered by PayPal Buyer Protection.

Yes it was covered by a Paypal payment. He has provided a tracking number, and it states the item was delivered at my address some 1.5 week ago, and signed for! It's one damn mess, i hope PP can sort this out for me and refund, i'm tired of listening to this guy with his either "ignore" or "rubbish" mode replies.
