Buying a returned item [consumer rights thread]

Following on from this thread http://forums.overclockers.co.uk/showthread.php?t=17995604 my parents have bought a plasma for their living room. The box looked sealed and not resealed, but once we cracked it open the bag with the batteries had been cut open, as had the bag for the stand and there was a manual for a Blu-Ray play in the box that, curiously enough, had a cigarette burn through it.

Now, the TV works fine, is in perfect condition without any dust, fingerprints etc, nothing is missing, so clearly as this shop has a 90-day returns policy on electrical goods, someone didn't like it and returned it, it was resealed and we bought it.

So, the parents are up on their high-horses that this is illegal, you can't sell second hand goods etc. and they want a discount. I should add this was the last TV on the shelf and I believe the model has been retired anyway. My argument is that as long as the TV is in perfect condition it is new and they don't have a legal leg to stand on. The best they'd get to return the TV and get their money back. If they had to discount on returned goods no shop would ever offer a money back guarantee.

Thoughts? Rights-wise, surely the best they'll get is a refund... and no TV!
