Can I get out of my contract.

Will try to keep a long story short, but would appreciate some advice and/or loopholes that anyones know about as this is now driving me around the bend.

2003 - Take out O2 contract, £20 a month.

Feb07 - Take out new contract (keep £20 a month one) for Orbit, £40pm

Mar07 - O2 take money out of wrong account (personal one, not business).

Apr07 - O2 don't take money, Block Phone. I pay on Visa. Ask for DD mandate.

May07 - O2 don't take money. Don't block phone. (ring and ask for mandate!)

Jun07 - O2 don't take money. Don't block phone. (still waiting for mandate!)

Jul07 - O2 don't take money. Block phone. Pay on visa. Ask for mandate.

Aug07 - O2 don't take money. Block phone. Pay on Visa, set up electronic transfer.

Sep07 - O2 block phone. Say they've received money too late. I change payment date to be 7 days sooner.

Oct07 - O2 block phone. Say they've NOT received any payment. It HAS gone from my account. They investigate.

Nov07 - O2 block phone. Say they've received money too late. I say tough! Transfer date was moved, their problem.

Dec07 - O2 take money! Phone stays working. Woo hoo!!

Jan08 - O2 take money. But take the £40 and put it on the £20 resulting in other contract been 2 months in credit and block my phone. Get it resolved.

Now here I am. I was ******* furious. I was going to cancel my contract and go elsewhere, but got offered a great deal from O2 for an Orbit2, 1000mins, 400texts, free phone. They've sent and confirmed receipt of direct debit mandate, and sure enough the money has gone from my account.

Had some issues. Received a 3G sim from them, switched it over and it immediately blocked my phone because of the Jan08 incident but 4 days (yeah, 4 days!!) later, it was resolved.

But guess what? They've blocked my phone again. They've confirmed they've received payment, but are saying that I owe for Jan 08, despite them confirming over the phone that they can see there was a problem, this hasn't been resolved yet and my account is in some kind of middle-ground area!

Bearing in mind that I've just started this contract just over 3 weeks ago, do I have any powers to just simply say "Up yours O2" and walk away. When I took out this new contract I had 14 days to return/cancel which has now expired but I just can't bear the thought of going through the same rubbish again for another 12 months and have to use my phone for business.

Just like to add, that the ORIGINAL contract that I took out in 2003 has never been a problem! Every month they've took money out, never once been blocked (my wife now uses that one).

I want to phone up tonight and simply try and cancel (which is a shame because the Orbit2 is a God-send for me as I develop apps on mobiles and it's a good tool to test apps on).

Any thought? Can I get out of this "joke" now?
 
I would be writing a letter to them asking to get out of contract with them for above reasons, and tell them you have cc'd it to there govering body. If they don't cancel you send it to there govering body.
 
you have no chance of cancelling without term fee's!

which department of o2 are you with? :S we dont usually send mandates for DD's, we just set the dd on the screen, there and then, and as long as its set up for your bill date then 14 days later it will come out of your bank, no issue at all...
 
Without knowing why the Direct debit wasn't going through or set up each month, it's impossible to say. It's unlikely you'll be able to get out of the contract though, to be entirely honest.
 
Well, surprised me, but I have now come out of it.

I won't bore you with the ridiculous events, but in a nutshell O2 today have not only 'blocked' my phone, but actually closed my account!

When I asked why, they said it was because they've been awaiting payment of £40 since December. When I explained that this was paid, the lad confirmed he could see it. He also confirmed that he could see the discrepancy with the £40 going onto the wrong account in January 08 and also confirmed that my money had gone out last week (Thursday) for February.

But these had gone again to my other phone account. I now have one phone which I pay £20 per month, but have now amassed a £180 credit on the phone!

When I asked WHY they were still debiting money from my account to pay for a phone that was constantly in credit, he couldn't answer.

As for the Orbit2, the system had that down as a "Replacement" phone and not a "Renewal of contract", hence why I was able to get a new phone even though technically my account was in some kinda account questioning.

All in all, totally confused me, the lad was baffled (but really apologetic), and 45mins later I walked away having agreed to return the phone upon receipt of an email with instructions and paying nothing.

Glad to get rid now. Still miffed I'll have no Orbit2 so will look to buy handset only and see if I can get a sim-only tariff from somewhere.

What an experience!
 
Just skimmed through this thread so sorry if this has already been mentioned , but I wold check your credit score all those failed DD won't be looking good on CC file. Least O2 or your bank (who evers fault it is ) can do is pay for them marks to be taken off

I wouldn't be to sure , as dolph will no doubt say mobile companies are one of the worst to bounce your DD's it happened to me with O2 years ago when they got mixed up with my DD.

got to be worth £3 to check and put your mind at rest.

BTW good luck with O2 also
 
thats why i don;t have a dd setup for my contract i just phone up on the day of my bill and pay it with my debt card saves problems like this
