Cancel O2 Contract Now Penalty Free (hurry!)

Hi

If anyone has a O2 contract, you can cancel now penalty free. This is what you must do:

Write a simple letter to their disconnections department (USE ROYAL MAIL RECORDED DELIVERY)

Write in your letter that because O2 has changed your terms and conditions using charging for ringing 07744 & 07755 numbers that this put`s you at a disadvantage under clause 8.4 c of your terms.

At the moment O2 let you ring 07744 & 07755 numbers out of your free x minutes, but from the 1st July they will charge you 25p a minute.

This is your get out of contract free.

Hurry and get the letter in the post.


Terms and conditions

"8.4 You may end this Agreement by giving us written notice if:
(a) we break this Agreement in any way and we do not correct the situation within 7 days of your request;
(b) we go into liquidation or a Receiver is appointed over our assets; or
© we increase Charges for your Inclusive Calls or your monthly line rental charge or change this Agreement to your significant disadvantage, provided you give us a minimum of 30 days written notice (and provided you notify us within one month of our telling you about the changes). This does not apply where the increase or change relates solely to Additional Services in which case you may cancel, or stop using, that Additional Service.
In the situations described in 8.4 above paragraph 8.3 will not apply"

I just got this reply back from o2

"Dear

Thank you for contacting O2 Customer Service.

I am sorry for any inconvenience that may have been caused.

You are eligible to cancel your contract without paying the termination charges.

If you want to cancel your contract, please reply to this email.

If you want to transfer your mobile number to a business tariff, please call us on 08702 410 202 and one of our friendly advisors will be able to help you further.

Our lines are open Monday to Friday between 8:00am and 9:00pm, Saturday between 8:30am and 6:00pm and Sunday between 9:00am and 6:00pm. Calls are charged at national rate"


I did not write in to them i emailed them using their online service
 
just had a quick check and it looks like you dial one of those numbers then input the number of a foreign country you want to call and you can do it for the price of the 07755-44 call
 
Sweet! might cancel my contract and get a new one to get a new phone or won't they allow that? It says 1st July there - thats tomorrow! when it says hurry does that mean I should have done it like 3 days ago :confused:
 
when did the original announcement for this happen? i'd love to cancel my contract but it says it had to be done within 30 days of the announcement of the changes.
 
Does anyone know when these changes where announced as i signed up to a new O2 contract 5th May 2006.

Is there still time to cancel?
 
This is the email i got back

"Thank you for contacting O2 Customer Service.

I am sorry that you want to cancel your Pay Monthly contract.

You are eligible to cancel your contract as per the clause 8.4 of the Terms and Conditions.

If you want to cancel your contract, please reply to this email and we will forward your details to our Cancellation team who will help you further.

You can also contact our Cancellation team on 08702 410 202. They are available Monday to Saturday between 8:00am and 8:00pm and on Sunday between 10:00am and 6:00pm. Calls are charged at national rate"


I phoned the number and the guy did not have a clue about the breach of contract and was laying the increased costs on the third party.

So i just put the phone down and doing all my conversations via email!

No, CPW does its own O2 billing so the contract is through CPW, not O2. However, all the CPWS O2/Voda customers are being transferred to the actual networks for billing this summer.

In any case, whether you can cancel from this reason depends on whether CPWS O2 also changed their rates for 07744/55 in the same way (and also whether they have the same provision for cancellation under such cases). Best to check the small print.
 
Is this appliccable for O2 Active customers as well? They *did* change the T&Cs a while back, though i don't know exactly when
 
I sent this in because o2 have really ****ed me off recently, so did my mate but she got this reply

So maybe we cant cancel without a charge anymore? I so want a new phone and provider.
 
Well i've already recieved an email from them saying i can cancel my contract due to clause 8.4(c) so they best not go back on their email.

How would this email stand legally?

How did you word the email you sent them through the web form. Surely you could say that you did not get the email with the change of tariff etc
 
I emailed to the following words (ish)


"Hi, I have noticed o2 have made recent changes to their terms and conditions with regards to charging 25p flat rate for 07744 and 07755 numbers which where previously included in x-net minutes.

Could you please let me know where i stand with my contract agreement with regards to clause 8.4(c) where o2 have breeched the agreeement.

Am i correct in suggesting i have the right to cancel my contract due to these circumstances?

freaky, i've been trying to get out of my contract and my phone is bust. Thanks for this, hope it works :)
