Car clamped, help and advice needed quickly

Hi there as i speak my car is clamped by a balif...Here is the story.

Got a letter saying i have to go to court
I gave the details of the driver with evidence
I got later from ballif saying i have to pay
I sent letter to ballif that i wasnt the driver as at the time
The ballif people said there is not much they can do but i will bent sent a document to point me in the right direction.

This morning, i was woken up by the ballif who has clamped my cart and demanded 600pounds :( , I have explained the situation to him and he's ask me to call the headoffice, which i did. Headoffices says i need to speak to him!

Now he is getting aggresive and not being helpful.....what are my options? My vehicle is got a big chain on it. I have also called the police as he dosent seem helpful. He wants a whole payment but i offered to pay via arrangement of some sort - installmentally....but he want all the monies.

If my car is towed away, it would be crushed within 5days.

In all honesty, i tried to sort this mess out as i am the registered keeper but i wasnt given an information as to what to do and now they want 600box...

Seems to me that you were trying to escape a fine, and didn't manage it.

I am the registered keeper, so all fines automatically comes in my name..
 
Guys thanks for your support.....here is the news

I offered him 100pounds but he wanted 500, the thing is i dont have that amount and my saving wont allow withdrawal without prior notice. :mad: :(

Ok so far so bad and it even get worse....I tried to be resonable to the guy but he was adamant on towing away the vehicle, so few of mine neighbours/friends came around and block the drive way and then i got on to jack the vehicle and unscrew the wheel nut. I manage to put the spare on and ready to roll.....then guess what.....the boys in blue showed up!! :(

They (police) initially called and say they aint getting invole as it is a civil matter then they magically appear like houdini (sp?), anyway they stoped me from getting into the vehicle but one of my neighbour refuse to move the vehicle blocking the pathway.....

After several hours of stand off, more police arrived and eventually my friend had to move his car. Now at this point the tow truck bar is sliding underneath my vehicle and while my friend distracted the police, i jumped in my car and lock the doors. :p Since i felt violated...but i did something stupid, i started the engine vehicle and then all hell broke loose :eek:

The police brought out their magic stick - you know the long one for smashing windows - baton. and they was all acting like a swat team. So i was like "damm they gonna smash my baby then STILL tow it away"....so i decided to turn the engine off and put my hands on the dash... At this point i counted 8 officers, as it appears the whole thing was getting out of hand, after protesting for 10mins or so, i came out of the car and they unthinkable happened......They towed my car and now the bill is gone up to 889.02pounds.

On top of that, i have five days to ocme up with the money or it will get crush. Since i have to let my bank know in advance before i can take out my savings, i decided to get an advance from my work place.....That means im getting noting at the end of the month...

...I feel ***** up. Anyway im gonna get the vehicle back in three days time. thanks for reading.

My mechanic, i have forwarded all the require information but ballif company says i am still liable BUT will send me a document on what i need to do. That was what i was waiting for but i got the ballif instead.

More bad news :( Work place wont offer an advance due to people abusing the priviledge - they take the money and quit.

Im so ***** up and i feel rubbish. I feel like the main actor in 24. I have to come up quick with 800+ in 5days time, How do i do that?..I have 100pounds and that's about it.

Iirc 14 working days or so. it is not the days in question here but the fact that it is joint btw me and my girl friend - she due next month, She aint happy about the whole thing and one or two things ..... I dont wanna go into details as she frequent here sometimes, whilst "browsing" **snooping on me**

I feel like the whole world is upside down and not going my way at all today.

What do you mean by your mechanic? Is this a garage or just someone you know who is a mechanic? Did they not tell you about the fine there and then when you picked the car up?

Why didn't you make a fuss at the time to the mechanic and even if they hid it from you until you got a reminder in the post, why didn't you go down there and ask why they didn't tell you.

We have a clamper operating on our car park and two lads went off and bought bolt cutters, cut the chain and off they went. Clamper always takes a pic and records the vehicle details. The police had to go to the lads house who were potentially liable to criminal damage.

Only in this country!

He is my friend (the mechanic) He is aware of the whole situation but believe it or not he travelled home for his mum funeral.

I fowarded all the right document but the court failed to act on it and when the ballif made the initial contact via post i emailed then and forwarded the same documents i gave to the court. They did acknowledged it BUT said they will get back to me so as to what to do. Now that was what i waited on but i got the ballif at my door this morning instead. Even though they claimed they got back to me i didnt see anything so the dispute goes on....I feel drained.. :(

I didnt dodge the system, perhaps you didnt see my other post. if a car is in my name, why would i wanna refuse payment if I WAS THE DRIVER AT THE ACTUAL TIME?

I wasnt the driver and i did try to get it sorted but it appears there is a breakdown in communication of some sort along the line.....whichever way, i will have to pay.

You are tryingto avoid paying that by saying that you weren't the driver.
Why are you not understanding the law as written on the link posted by Burnsy2003 - your argument is not a valid defence and you the registered keeper of the car are 100% liable for the original fine.
This is why the court did not cancel the original fine.
This is why a summons was issued agaisnt you for non-payment.
Stop deluding yourself about submitting forms/breakdown in communication.
You are the registered keeper of the vehicle and in law you are liable for the fine.
End of argument.

Sigh.... I wasnt the driver but i did mentioned in my earlier post that i am liable as i am the registered keeper. I went away after i posted the thread to sort out the whole issue.

I still dont understand why people think im lying or trying to avoid payment. My friend did accept the charge but the court didnt follow it up (now i know why).

The bone of contention here , that people seem to be missing is the fact I was told i would be sent a document so as to know what to do as the matter is out of the court hands now but i never received it, even though they claimed they did sent it.

I dont want any sympathy, i just wanted advice as to what to do - this aint happen to me before.

It seems the ticket was issued around (or before) october 05 iirc and my flat was involed in a fire incident Nov 05. I had to move into a hostel/temp accomodation, whilst the place was repaired. it would have been around this time the summons was sent...(maybe) I didnt see any summons but an aftermath letter from the court which i then chased up....

....I am drained man,..and im at work better stop.

It states on the back of the documents that No Cheques, Credit cards or money transfer due to persistent fraud.

They will track you down via your details and if they cant get hold of you, some of them will swipe your card virtually. :)

best thing to do is pay up, even if u know u are wrong doing so. they have set up a system and then set up another one to stop u trying to get round the first one. fighting it is silly....so the way to deal with this is simple...

take the money from someone else, trip over a raised path stone or claim from some other free place the tax payer is coughing up for, u can easily suffer depression and need time off work for it and thats why u pay national insurance. u may feel bad about it at first but unless u want to take it up the rear u have no other choice. remember, dont fight the system, use it for ** own needs.
