CBR600F 1997 - written off after crash, written off twice before!!!

Hello.
My old bike, a CBR600F which i sold to a mate last April has been written off after a complete div side swiped him in Wimbledon, thnakfully he's ok bar a very bruised foot, sore knee and aches.
The bike didnt go down but ripped the rear LHS peg off, cracked the heal plate and bent the peg bracket into the swingarm and cracked the engine cover, front LHS lower fairing and hugger. As its 1997 the 3rd parties insurer wrote it off and offered £720 payout which he has refused as that wont buy a similar bike...but its come to light the bike was written off twice before as Cat D!
I bought this bike from a shop in Camden, Lazer bikes, and I was not made aware of this, I asked after its history and was told it had none bad they knew off, this is verbally only so I have no physical record of that.
Now the insurance offer is low as the bikes been written off before, do I have any comeback on the shop for selling the bike to me knowing or unknowingly that it was already a write off x 2 before.

Any advice or oppinion offered appreciated!

I'm afraid not - I was in a similar (but more perverse) situation with my Aprilia RS125 :(

You even quote... none bad "that they knew of"... which is too abiguous

If you had specifically asked for it's insurance write-off history (or similar) and they had performed an HPI check on the vehicle (not mandatory, but most real dealers will do one) then they are legally obliged to tell you... BUT only if you ask the specific question, they do not have to offer the information

I feel for you - I know what it's like - incredibly frustrating

Personally... I always ask the direct questions and perform my own HPI check before buying any vehicle anymore. It's only a tenner (or £3 for the limited info text service) and a couple of questions when you're looking to spend 1000s, so well worth it.




If I were you... I would pester the insurance company more as that sounds like a stupid figure. I sold my CBR600F-S (1995) for £750 only a couple of weeks ago... it was a piece of crap, but could still have easily reached £1000 judging by other similar vehicles on pistonheads/trader... I only let it go that low because I was in a rush and I liked the guy, had an ebay offer for £900 less than an hour after the guy left with it - lol!

And that was a really ratty one... sure the mechanics were good, but the bodywork and paint condition were terrible.

You're looking at £1200-1400 for a reasonable one!

As it was only a cat d (aesthetic)... make sure you drill in to them that the aesthetic issues had long since been resolved and the bike was in a state that no longer represented its ex-cat d state.

Also look in to how long ago the last cat d was paid off... that might help your negotiation if it was a while ago...

Insurance companies will always low-ball... you have to fight to get the amount you're due.

How much was its value declared at with your friends insurer?
