Debt collection agencys! Need advice!

Hey guys!

OK, so i forgot about a fine and it was passed on to a debt collection agency.

I rang the DCA up and they said i couldn't pay the fine because my details wernt on the system yet. The kind lady suggested i should wait until i receive a letter from them with my reference number on etc etc.

I waited a week and still no letter so i rang them again.... same response from the ever so kind woman!!

Fast forward to today and ive had bailiffs round the house demanding money due to no response from me! I tried to ring them and speak to the kind lady again but this time got a rude woman who couldnt give 2 ****'s! She told me that 3 letters were sent out over the last month, but i didnt receive any of them.... that didnt interest her.

So, do i have any rights or am i stuck with having to pay there stupid costs... £250!!

If i received a letter from them then i would have paid the fine and there small admin cost... but im not happy about paying the £250 cost!

Do i have a leg to stand on?!

If they're court bailiffs you're ******.

If they're not, don't let them in.

How did you "forget" to pay a fine without the police coming to lift you for a re-appearance in court? (or was it a parking fine etc?)
 
No there not court bailiffs, there just an agency.

I forgot because i went on holiday for 3 weeks and it slipped my mind... it was just a parking ticket.
 
This is why you always take the name of the person when you call: traceability ;)

Write to the DCA (recorded delivery), explain the situation and how you plan to pay what's owed. Do NOT let the bailiffs through the door and don't leave any windows open/doors unlocked.

You could also contact the council where you got the ticket and see if they can help.
 
don't pay, send a letter recorded delivery explaining the situation and requesting the original letter, also get down to the cab and if practical seek legal advice. It sounds like a scam to me.
 
Was it a council parking ticket?

If it was then go in person to the local council office and get some sense from them. They should be able to get you in contact with the relevant office.

IF it was a private parking company then inform the collection agency that the debt is in dispute and legally they cannot contact you further... only the original company can. If they continue to contact you its regarded as harrasment and you can get the police involved ( well threaten it anyway ).

When the original company contact you goto http://www.pepipoo.com/ and follow the advice there.

Private parking companies have no real legal basis to issue "fines" and most times all they amount to is invoices that you can ignore.
