My father just rang me to tell me my sister was in an accident, her nipper was in the back and she hit another car, she was breathalysed and was 3 times over the limit.

Nobody was injured thankfully and as far as I know she's safe in the cop shop where my mother can't throttle her.

What's the likely penalty for it? I've told the old feller that it's probably a 2 year ban, big fine, poss. community service, her insurance not paying for any of the damage to her or the other poor chaps car and a massive hike in her insurance when the ban is lifted, also if the the other driver decides he's got whiplash he'll be sueing her, anything else I'm missing?

Cheers.

3 times is pretty serious and with a kid in they are likely to look very badly on it

2 yr would be minimum ban she could hope for IMO , I would say 3yr more likely , fine of maybe £1000

insurance should pay form other car but probably not for hers

insurance will be a nightmare for many years

Sounds about right although her insurance will pay for HIS damage. Just not your sisters afaik.

P.S - You're sister is retarded, kid in the back too? Shocking. Can social services step in here? Endangering the childs life etc.

I would be less worried about the driving ban and more worried how social services may view her following a chat with the Police.

What was she doing drinking during the day?!

I would expect a 2 year ban from driving, a hefty fine and a throttling from her Mum! How old is she by the way?

I don't know about Social Services but the judge will very likely come down on her like a ton of bricks for being 3 times over the limit with her kid in the back seat.

3 times over the limit is quite a bit too. It certainly wasn't a mistake. She'd have been fully aware that she was not fit to drive but chose to do so anyway. That's irresponsible enough by yourself but with your own child? That speaks volumes.

Does she have an alcohol problem?

What was she doing drink driving you mean, regardless of the time of day. May as well walk out of the house with rotating blades swirling around you.

oh dear, i wouldn't even consider one drink with my son in the back of the car. Was the drink that important so as to put her childs life at risk as well as her own and others. Shame on her and they will 'hopefully' come down hard on her, silly girl.

Yeah, she's an alcoholic. I suspect social services will get involved and while I'm happy to point out to her what the penalties for her incredibly stupid and selfish actions are it's not something I'm going to mention, I'll let her worry about it if and when it happens.

So more than likely a 3 year ban with whatever the magistrate see's fit to add on top for endangering her sons life?
