it was driving without due care and attention.

he queued up behind the car in front but there were cars (he assumed were parked) to his left. he broke the law and thats that in the eyes of the court. the judges weren't that interested in why he did it
 
So if the cars on the left weren't parked as he assumed, exactly what were they doing if they werent queuing ? The only thing left is moving, as thats all traffic can be. Moving, or stationary. If they were stationary, they can only be either queuing or parked. But you wouldnt assume moving cars are parked ....
 
I wonder where he lives that people park in neat, orderly queues away from the kerb, and remain seated in the cars after parking, with the engines running?

Surely the fact they've still got people in the driving seat is a reasonable give away that they probably aren't parked up? (I know when I'm approaching parked cars I tend to keep an eye open for signs there is someone in them...if just so I can allow a bit more room in case of doors being opened).
