eBay: Package I sent not arrived...

Hey guys,

just looking for some advice really. I sold an item on ebay and sent it to the buyer using royal mail recorded delivery. That was about two weeks ago but he still hasn't received it. It's possible that it may just be delayed due to the christmas post but what happens if he doesn't receive it? Has anyone been in this situation before? I'm just wondering if I am liable to give him a refund or if (as I suspect) it is in fact him that is responsible after I have sent it and provided him proof of delivery.

Any help would be appreciated! :)
 
If the payment was through paypal and it was sent to a confirmed address, you have a chance. If not, then paypal backs the buyer.
 
Recorded delivery must be signed for on reciept, check with Royal Mail if it has been signed, if not it should be insured, what is the value?
 
proof of postage is everything. check with royal mail.
i suspect its only delayed because of christmas

if it has been lost/stolen make a claim.
if you have genuine proof of postage you are not liable for anything (but you can still be helpful of course :))
 
It is probably just because of christmas. I waited 2 weeks for a parcel posted to me by Royal Mail 1st class recorded, just got it a couple of days ago.
 
Hopefully the package will turn up.
Because you didn't use a fully trackable service (like RM Special Delivery) it makes claims through Paypal/Ebay that bit more difficult.

it doesn't matter that he didn't ask for it, you are the one who will get screwed over if he doesn't receive it. Always send special delivery for goods over £36+.

what does the RM website say when you put in the tracking number?

if it doesn't turn up you will have to reimburse him in full + losing out on RM claim as it was only insured up to £36.

lets hope it is just a delay.

Doesn't matter, you are responsible for the item arriving, it hasn't, so you must issue a full refund. Tough luck if your insurance doesn't cover you i'm afraid.

It says that standard "not yet delivered, try later" message. Ouch, I'll have to see what happens then. I'll send special delivery from now on!
 
How I understand it, recorded signed for is not good enough as it is not tracked. you have to use special delivery for this. If you cannot provide full tracking for the parcel then paypal will support the buyer.
 
The buyer is always in the strongest position here at almost all times - the seller is the one who has the obligation to deliver the goods or arrange for them to be delivered, you can put in as many disclaimers as you like, it all means nothing (not saying you have done this, but LOTS of sellers pull the old "I accept no responsibility if it never turns up" nonsense.

Of course in the commercial world with things like FOB etc this is all different but when it comes to stuff like this it certainly is the responsibility of the seller to ensure delivery and sort it out if it goes wrong.

If it has not arrived, you will need to take the matter up with the courier.
