Ebay sale quibble

I sold Fifa 11 in the following buy it now auction:

The buyer first complained it hadnt arrived in Spain on the 6th September after 7 days, then it arrived the next day.

Now today 8 days after that he sent the following mesage:

"Got a major problem with the game! I Cant play online with it and in your listing you said online was playable!! You've used the online pass which means i cant, Why wasnt this noted in the description??? I think an email to ebay is in need if this doesnt get solved!"

I filled out the "item specifics" in the assumption it describes the games capapabilities i.e multiplayer/online etc but I didnt fill it out as indication that I hadnt used the online pass. The auction states the game is used but doesnt mention anywhere that it includes the online pass, the auction states I have the full 1k which of course means I used the pass for the multiplayer part.

Not sure where I stand on this, I'm relatively new to ebay having sold 24 items but I've never had a problem before. I didnt rip him off, thats the general going rate for used fifa 11 without a pass.

Advice please!
 
I'd be inclined to offer him a refund. If you've said it is an online game then the buyer would resonably expect to be able to play it online.
 
Grey area as you don't say you haven't used the pass and you don't say that you have, I can see both sides. I wouldn't have a clue that 1000 gamer score meant it had been played online. You haven't lied in the listing so I guess it was up to the buyer to ask questions.
 
You have described the item as 'as new' and 'perfect condition'.

If I were buying an item that was 'as new' then I'd be miffed that I couldn't access the online function of the game.

Also I wouldn't put much weight on the gamerscore thing, its quite probable he doesn't know you need to use the online functionality to get 1000.
 
Ok I'll offer him a partial refund and see where it goes. i just looked at used fifa 11's online and none of the first 5 used I looked at mention wether an online pass is used or not.

wont bother with that stupid item specifics again!


If he complains to Ebay what will they do?

IMO you should have stated clearly that the online portion of the game was excluded, I know you've sold it cheaply but the way you've advertised it "Like new" etc is very misleading, not everyone will see the 1000 gamerscore statement as meaning that the multiplayer won't be available to them.
 
To be fair with game being advertised as "like new" i would expect the game to come with the online code, You would hardly advertise the game as "like new" if there was no instruction booklet or at the very least you would state there was no booklet. As a seller you should always assume the buyer is an absolute moron because more often than not. Stating 1000 gamer score probably wont cut it if he disputes as you could have multiple copies of the game
 
How much did you get for the game as it appears (having no experience of 360 games or EA passes!) from the internet that he'll need 800 Microsoft Points which is roughly £6.80 for a new pass.
