eBay Trouble...

My mates having a bit of trouble on eBay, He hasn't got an account here so I'll quote it from another forum...

I think its time to name and shame possibly the biggest idiot ive ever met, some of you may know ive been waiting for my sprayed vents/centre console/front speaker panels etc.

Well heres the story from the start to now....

I was searching around for a sprayed console when i came across a whole set with everything i wanted spraying anyway so i decided to bid on it. It eventually ended on £55 delivered which was a lot more than i hoped but i thought it would save me doing it myself.....how wrong was i!!

From the link you can see the person i bought it from and when it ended, take a look at his feedback and you'll start to notice more and more bad feedback being left on his page.

Anyway, the item bidding ended on the 18th october and i had sent the payment on the 20th october by bank transfer (which takes around 2-3 days to enter his account). He gave me his correct bank details etc so i knew the money had definatly went in as it had left my account.

4 days later, after the payment was sent (24th october)....

I decided to email him to find out if he had sent the items:

Hello,

Have you dispatched the items yet? I take it the payment has transferred as its been more than 3 days.

...1 day later (25th october)....

I get an email back:

hi let us have the item number and we can let you know thanks m,

So i emailed him the item number and the link to the item just to make sure he got it.

...3 days later (28th october)...

I hadnt heard anything from him for 3 days, by this time i was beginning to get annoyed so i sent him another email:

Hello,

Any update on the delivery?

...2 days later (30th october)...

I send another email:

Have you even sent the goods i paid £55 for? Been 12 days now and no confirmation or reply.

...By now im seriously annoyed as its been 10 days since payment was sent and i know 100% it has gone into his account. Then i get an email back....

As the item status states, you have marked as payment sent, i have not marked as payment recieved because I HAVE NOT RECIEVED ANY FORM OF PAYMENT!

Payment has been sent and transfered into the bank account you gave me details of, i know 100% that £55 has been put into your account. Now i know you are lieing so if you want to make this hard for yourself carry on.

what are you talking about No Swearing! do not call use liars if you have made a transfer it has not shown up on our account if you need to then phone marc on *removed* but watch your step mate he will take you apart bone by bone if you start this crap !!!

Lol if he isnt a liar what is he? I thought most people on ebay were nice people obviously i was wrong AGAIN.

I wouldnt start threatening either as you dont know me. £55 has been transfered into the account you gave me details of, money doesnt float around in mid air so its entered your bank account. Next step will be police involved, ebay clearly states they will help with police matters and i have all details of where the money has gone + your messages giving me the details.

After i sent the email i decided to ring the number.....i was explaining the situation to this marc bloke on the phone and wondered when my item was going to be sent...he even told me on the phone he recieved payment on the 26th yet the person emailing me (his son i believe) told me they hadnt recieved payment (as shown in an email quoted). The bloke on the phone also said i had threatened him on this email....

Now i know you are lieing so if you want to make this hard for yourself carry on.

Basically saying i will take further action with ebay etc.

......He then started getting aggresive on the phone and admitted to me he sold more drugs for a living than car parts (not really the sort of thing you should say on the phone)...bear in mind he also told me he was 48 years old.

After a bit of arguing he put the phone down.

I decided to email a person who left negative feedback on his page...

I noticed your comment on ...s profile, ive had the exact same response as you. He hasnt sent my item yet when payment was sent on the 20th october, i rang him and he started getting very rude on the phone. Has all the items been sent to you correctly?

yeah i got some stuff but im missing a dash pod,i paided well over the price for it to.it looks tacky and i aint even gona bother putting it in my car.Yeah i spoke to his son on the phone as well asking where it was and he said " ask postman pat".He was swearing etc,i also sent the cheque off to somewhere in cornwall and they reckon there place is in london?work that one out.But at the end of the day what can ya do.

Phoned the person i bought the items off again and he says the item was sent on the 8th November and that he would give me the tracking number after he is out of his car. (Was he talking bull?)

.....14 days later (13th November)

Goods still havent been recieved and no word from him about the tracking number, how long has he been in the car? 3 days? lol

By now im fuming but keep it cool.

Email back to him:

I paid by bank transfer on the 20th october, we spoke to mark? (the number you gave me) on the phone and he said the item was sent last thursday. So he says item has been sent and you say payment hasnt been recieved? Am i missing something here apart from the item i paid for.

That was the last email i sent him on the 13th. Tried ringing him past 2 days and sent him emails saying i will be contacting ebay etc but no response as of yet.

Update:

I opened a dispute against him last night on ebay and when i got home today had an email from ebay saying that ...s (the bloke) had responded saying i have not paid for the item...I HAVE A BANK STATEMENT PROVING I HAVE PAID FOR THE ITEM WITH HIS NAME ON IT and left negative feedback on my account as well as everyone elses who left negative feedback on his.

Unpaid dispute he has made against me:

...s has informed us that they have not yet received your payment for the following item: ...

we will find out why you have not received this and get back to you but i know we have received a lot
of threatening phone calls and emails from you and your family we have now reported this to ebay trust
and safety and are waiting for a reply from them.

You havent once had a threatening call or email wheres the proof? You agreed you had sent the items
out and all of a sudden 14 days on since payment you say i havent paid? I have PROOF that payment has
been made to you its called a Bank. I also have proof of you threatening me on an email + quoted all
the emails in order so we can see who is in the wrong. Look at all your negative feedback from other
members and your tryna say im in the wrong and that im scum? Your fighting a lost battle mate.

Sorry for the long post, that's the story up until now.

Because he paid via bank transfer I knwo the chances of him getting his money back are slim, but where can he go from here? Can the bank or eBay do anything?

I posted it here because I'm not really experienced in this sort of thing and I know a few of you are. Cheers

I don't get why he's sending some things out but not others. Haven't bought anything from ebay for about a year, with stories like this I won't be starting again any time soon...
 
I'm currently doing battle with some clown with a fake name who's given ebay the phone number of an Indian restaurant in London for his contact number :rolleyes:
 
I had an experience with an ebayer who won a GFX card off me but failed to pay, I opened a non payment dispute and relisted the item which sold to a more honest buyer who paid right away and all was good.

Few days later I left neg feedback for the first buyer for not paying for an item they bidded on, they responded back by saying they bidded on the wrong item and that I was a "great liar" saying that I never responded to his "messages"...why would a seller not respond to messages from a buyer who has not paid yet? :)

Countless replies back and forth with this guy who can't type english properly and in the end I just requested mutual feedback removal as this guy was too stupid to have comon sense so I just wanted to have nothing to do with it anymore.

A week later he agrees to mutually remove feedback and sends me a message saying "don't lie again" ... bizarre!

Anyway, I got my 100 feedback points back and am happy but do agree eBay is totally crap when it comes to moderating feedback.

In fact I emailed ebay about it saying I'd like the neg he left to be removed as from the message logs and auction I could prove that I communicated every step of the way and the buyer left false information in the feedback.

Ebay said they would NOT remove the feedback as it is not in breach of their feedback removal policy - so lying in ebay feedback is acceptable as far as eBay are concerned.

Now I never sell or buy from anyone who does not have respectable feedback.

This is where you started the childishness, and where it went downhill rapidly.
Since that email, he has responded in kid, and I don't see that you can complain about the way he is responding.
But as someone said, bank transfer+ebay= very little comeback.
 
It's only £55 mate, suggest you give up the ghost. A couple of hours on the shelves in your local supermarket and you will not only be back but wiser too.
 
I think you may be able to get it back if you say to your bank that the payment from paypal was unauthorised, they will claim back from the other party, if not then theres things your bank can do to help you and call to the local crime prevention unit wouldnt go a miss and get this dude on here as i need a noobie to claim..

PayPal? How is PayPal involved in any of this?


I would suggest you speak to your bank and see if they can do anything about it. Also speak to someone at your local police station and see if they can offer any advice.

3) His bank - should care as it [the acccount) is being used to comit fraud
4) Small Claims court

Try with 3 and then if its a no go then no4 to be honest

He may of paid via this, plus there is an unpaid item dispuite, isnt the only wa to do that via paypal, im not too sure.

also, the police should do something as it is classed as fruad this..

Read the opening post. It clearly has nothing to do with Paypal.

Yeah I see what you mean. My friend has said though that he only meant action with eBay etc, it's not as if he said "I'm going to come up there and smack your face in." It can be interpreted either way I suppose

Whether it's £55 or £55,000, the bloke is still in the wrong. How can you expect my friend to take it on the chin when he's been cheated out of his money? Yes he shouldn't have paid by BT, but this was unforeseeable as the blokes feedback at the time was pretty good.

I often use ebay and dont have any problems to be honest, I only buy from people who have a high feedback and only items which are pretty low risk, I would'nt buy high value items from ebay, I think the most i've ever spent on one item on ebay was between £100-£200.

As for your mate likely getting the cash back I would say its pretty slim, unless the police get involved or you can some how talk the bank into reversing the transfer as you wont get it back via ebay.

Definately get on to the police, take all the information you have.
 
I know people will moan & complain but this is the reason I only use Paypal with EBay.
Yes I know, some people seem to have issue with Paypal.
However considering the many hundreds of thousands of daily transactions Paypal do deal with I think you will find the actual percentage of problems is extremely low.

I use EBay a fair amount - mainly selling but I do my fair share of buying too.
My three rules of using EBay are:

1. I only deal with people in the UK with regards selling things. I never sell to any overseas buyers.
2. I use Paypal exclusively so I've always got proof of payments in both directions and EBay can immediately see this.
3. Any item I sell with a value of £40+ is always sent via a trackable postal method - RM Special Delivery, DHL or Citylink.
£40 is my own personal cut-off level as anything up to this value I can afford for postal services to mess up etc.

Following these rules I have a perfect EBay rating and have never lost more than approx. £20 in my online dealings.
