Got a question from a mate, basically he had his car broken into for the 2nd time today whilst at work, stupid chavs broke in but didnt steal owt, trashed the door lock though, he's wanting to know if the employer is responsible for the safety of the cars at the staff/customer car park, and if they should be liable to pay for the repair costs.

Not normally, thats why they have those signs up saying they take no responsibilty for loss or damage in their car parks

Dont quote me, thats just what I think

The place where I used to work had those up in the carpark as well... My friend had her car broken into outside where she works and the place took no responsibility.

That could just be for customers though. If his car was parked in specific staff parking not in the customer car park then maybe they could be??

Highly unlikely imo, otherwise who's to say someone will fake a break in and cash in?

At my old place of work there were no customers - it was an office.

They had security men, 24 hr cameras and they still didn't take responsibility!

Interesting one actually. Normally the proprietor would have to put up a disclaimer.

/me makes mental note to put up disclaimer in our office car park ;)

Disclaimers aren't worth the board (or paper) they are written on: no-one can legally waive a right that they have under law. Either the employer has a liability, or it doesn't, and essentially it doesn't. It has a legal obligation to you, but not to your car, even in a secure carpark. Those signs are just to remind you of the fact.

It is written into our contract of employment that any personal property left on site (that includes cars or stuff in desks should the office get broken into) isn't the responsibility of the company should it get damaged/stolen/whatever.

There are signs to that effect in both the car parks, too.

be thankfull that you HAVE somewhere to park
at M&S truro (worked there when I was at college as they payed better than tescos) they HAVE a carpark, but you can't use it if you work there!
