Ever have someone send you something without you even paying?

If it was sent by a company youd have been covered by the sale of goods act - anything sent via post to you that you wernt expecting or hadnt agreed to buy is a gift and you don't have to return/ pay for it

Pretty sure you do if they realise the error and notify you of it.. You can insist that they do all the effort of returning it but just ignoring them is just theft surely?

Really? I thought you had to return it or the seller arranges collection.

So if a company accidently send you a £million in diamonds you can keep them?
 
You can only keep it if a company sends you something without you asking for it, then try to force you to pay for it. If they merely made a mistake, and shipped multiple items, or sent it to the wrong address, you have no legal right to keep it. They obviously are responsible for the costs of returning the item though.

Well the definition of theft is the dishonest acquisition of goods with the intention of permanently depriving the owner of them.

An acquisition in law means taking control of those goods- treating them as your own by using or selling is an acquisition.

So yes a liberal interpretation of the Theft Act could read as theft. As I said its a grey area where the law of contract overlaps criminal responsibility. The seller has rights under the distance selling regs and under the sale of goods act as well as under the doctrines of contract.

Contract law is very much focused around consumer protection il check the sale of goods act provisions tomorrow but I'm pretty sure I'm at least half right
 
Once we got a load of exotic dancer instructional vids through the post, how to dance with nipple tassels etc, bizarre. Don't actually know what happened to them :/
 
OC would be a good example of this. They send Haribo's out.

Or Perfume shops.. I've bought a few online and get free samples and so on.
 
I had this once on eBay. Received an item I'd yet to pay for and was rather surprised/confused. Can't remember what it was now though, but it wasn't of particularly high value. Some sellers are odd.
 
I ordered some supplements years ago, paid by cheque which bounced postman turned up with my order one day and a letter the day after saying the cheque had bounced and they had stopped the delivery and holding it at the depot.

If I wanted it delivered I would have to pay again and pay extra to cover charges.
