You need to read you insurance documents. Accidental damage cover may not include malicious damage. Depends on how you want to play it, but generally insurance claims work better when you use the truth rather than saying that your ex let go of the Wii controller at the wrong time.

Generally no, if you let them in the house most house insurance policies won't cover malicious damage.

I was reading my policy today and it said that I couldnt claim for theft or damage on anything that involved somebody invited into my property or here without the use of force.
