/facepalms little query regarding my rights (supermarket related)

On Sunday, doing my "big shop" I went past the books and happened to pass the games section, spotted Tiger woods on the 360 so I snapped it up for £30.

Of course later that day when I went to have a game I realised it was the Xbox version *doh* But now two days later I've been told by the girl at the stores customer services that she can only swap it for the same title but the 360 version, which they don't stock as it's not in the top 15.

I can't fault her she's very polite etc but I feel a little shafted, she suggested I wait until it's in the top 15 then come back and swap it!

Since I use to work on customer services I was very polite and I'm not particularly annoyed as it was my OWN FAULT but I just felt it's a little rubbish that I can't even swap it for another game :( It's been opened but in perfect order, no scatches, no marks and I have the reciept (I tried it in the console to see if it worked, if it did I'd just have played it!).

Feel free to abuse me for my own stupidity, that's what the internet is for! :D

The trouble is if you could return opened, perfectly working games then people would buy a game, copy it, return it and get another etc... The same policy I'm sure applies with audio CDs.

Unfortunately the item is as described and all the rest of it and you really have no comeback other than the goodwill of the customer services person you deal with.

Yeah I know mate, problem is it wasn't sealed when I got it. Which is why I tried it in the console :p

I use to work in customer services so I know the rubbish they get told day in and day out. Just a little miffed that's all, it's fairly obvious I'm not trying to rip anyone off and I'd happily exchange it for the 360 version so I guess I'll just have to wait :( would be nice if they offered to swap it for something they stocked though :)
 
It is down to the retailer's discretion whether to refund you or swap it for another product or not when there is no fault in the product. Changing your mind or getting the wrong item doesn't apply sorry. Best is to speak to the manager, be polite and explain it to him, that is your best chance of getting it sorted.

You're not legally entitled to any form of refund or replacement (even vouchers), since there was nothing wrong with the game you bought. If they have a store policy that says they will exchange games, perhaps try and ask them about it, or in any case maybe write a polite letter to their head office. You don't have any legal right to return something because you chose the wrong product.
 
How does that apply? I've never even thought about it but I often buy clothes, get em home, try em on, don't look right or I just change my mind and don't like them and take them back, I always get full cash refund no questions asked
 
I think it's the possibility of me having copied the game, then taken it back mate. I can see their point really. Just hope the game appears in thier top 15 soon so I can swap it :P

Then you're shopping in the right stores.
Stores do not have to accept anything back simply for the reason "I don't like it".
If given the opportunity to try on before purchase "Wrong Size" is also not a valid excuse.
You're only got rights with regards faulty or "not fit for purpose" purchases.
 
TBH I would go back again (or to a different store if theres one local) and say you gave it to your imaginary nephew and he tried it but it didn't work :o

Yeah a bit dishonest but I don't think Tesco would go bankrupt over it. They could have easily swapped it or given a refund in the first place as their "new" games are always stuffed behind the counter out of their boxes anyway.

:eek: I'll be more careful in future then, honestly I always leave the label on and keep the receipt and I've not once had a problem, but yeah, thanks.
