Faulty item within warranty, need advice

It's probably one of the standard messages in their RMA software, thats all - as soon as an RMA is not accepted, the standard email is spouted out.

Nothing personal, I am sure


Just got another email from them.

"We are unable to accept your goods as the item is no longer covered by its warranty. The goods will be returned with no further action. "

Sounds like they're trying to cover up their dirty tracks.
 
I would seriously "lawl" if they've deliberately opened the caddy or caused some kind of damage in order to claim you sent it in that way, with warranty void.

Well, the agent I spoke to at WD knows all of the details incase they did do that. I highly doubt they would do something so low.
 
This falls under the Sale of Goods Act and requires that :

You have the right to get a faulty item replaced or repaired, if you're happy with this (or if it's too late to reject it). You can ask the retailer to do either, but they can normally choose to do whatever would be cheapest.

Under the Sale of Goods Act, the retailer must either repair or replace the goods 'within a reasonable time but without causing significant inconvenience'. If the seller doesn't do this, you are entitled to claim either:

reduction on the purchase price, or
your money back, minus an amount for the usage you've had of the goods (called 'recision').

Sounds to me like they're offering you a "recision", which is legally within the framework of the sale of goods act, but doesn't win any repeat business from you.

Your best bet is to either take the money or get them to repair/ replace it as: If the retailer refuses to repair the goods, and they won't replace them either, you may have the right to arrange for someone else to repair it, and then claim compensation from the retailer for the cost of doing this (lengthy and you'll be out of pocket for a while, but if you're feeling vindictive, makes for a little fun!)

...yeah, or just send it to Western Digital, which is far and away the easiest and best option available.
 
I RMA'd it with WD. Sadly the guy got the serial number mixed up and I ended up getting a 1.5TB back. I called up to complain and he admitted he may have gotten the serial numbers mixed up (this was last week). Today i received two parcels.... each containing a 2TB external drive in.

Call them, explain that they sent you too many drives and that they will be fine to arrange a courier to collect them.

They'll probably say to keep them, as arranging a pick up and drop off will probably cost them 1/2 the price of the drives they've sent you... if not, then at least you've been honest!
