Guy got arrested for making racist comments on twitter about Muamba

What the little twerp typed was way out of line but prison is a ridiculous over-reaction. A fairly hefty fine, yes.

I was watching some comedy on youtube last night and a black comedian on Leno made the following joke:

"I like all women, black and white. Yeah I like white women, that's why I can't bring myself to hate white men, when my brothers be all like 'kill whitey' I'm like , 'hell no! We need them suckas to breed!'"

Just a joke, and he was clearly a decent person and a funny comedian, but in the context of this hysteria, what if the opposite was posted on twitter? Reverse the black and whites in that joke and you've got something that would NEVER get on televison and likely would have people on Twitter reporting it to the police.

Welcome to the world of double standards. How unfortunate that we're entering a time of genuine oppression of freedom of speech, no matter how abhorrent it may be, for one of the world's races at least. For the rest of them it's open season to a far greater extent.

Yes a joke and intentionally hateful comments are far removed, but in the context of the collections of words they constitute are they really? It seems interpretation and context, and more importantly political agendas are everything in these matters.

With regards to the fellow and his tweets... I agree what he said was wrong. However, cracking down on such petty tweeters is a waste of police time and money. I'd sooner more time and effort were put into finding and locking up those who prey on kids.

Just a small point. As I understand it racism is not illegal.

If person X says "I don't like black people" he hasn't broken the law.

Where is becomes illegal is when it incites violence or racial hatred.

If person X says "Black people should all be beaten up" then he has crossed the line.

Also if the racism becomes abusive it breaks the law.

Why shouldn't free speech mean you can say what you want? Is it because it *might* offend someone? OMG the horror!!!

Well what if I walk down the street in a barbie costume... I'm sure that would offend quite a lot of people... Does it mean barbie costumes should be banned too? People get offended at different things and at different levels. I for one couldn't give a rat's *** what someone says about me online (or in real life for that matter). I just ignore it and move on, like others should. If you are not being FORCED to do something or have an opinion imposed upon you, then I don't see the problem.

The moment you begin limiting what people say is a very dangerous time indeed, because we create farm more harm for ourselves through the limitation of freedom of speed, than could ever be caused by some idiot typing silly messages on a social site.

At the end of the day this guy has an opinion. To most (including myself) a very stupid idiotic one, but nevertherless an opinion. He should be allowed to say it, just as I should be allowed to type this message.

Thanks "freedom" :D

Yes well this is where you get into other problems... How do you prove he incited violence? Did someone go outside and beat up a black person because of a message they read on Twitter. Can you prove that?

Or are you saying he got jailed because he *maybe* caused violence. And if he *maybe* did that, then I'm sure lots of other people *maybe* did lots of other things too. Is this Minority Report or what?

Im afraid you are wrong. Racism is illegal:
s28 Crime & Disorder Act 1998:

Meaning of “ [F1racially or religiously aggravated]”.(1)An offence is [F1racially or religiously aggravated] for the purposes of sections 29 to 32 below if—
(a)at the time of committing the offence, or immediately before or after doing so, the offender demonstrates towards the victim of the offence hostility based on the victim’s membership (or presumed membership) of a [F2racial or religious group]; or
(b)the offence is motivated (wholly or partly) by hostility towards members of a [F2racial or religious group] based on their membership of that group.
(2)In subsection (1)(a) above—
“membership”, in relation to a [F2racial or religious group], includes association with members of that group;“presumed” means presumed by the offender.(3)It is immaterial for the purposes of paragraph (a) or (b) of subsection (1) above whether or not the offender’s hostility is also based, to any extent, [F3on any other factor not mentioned in that paragraph.]
(4)In this section “racial group” means a group of persons defined by reference to race, colour, nationality (including citizenship) or ethnic or national origins.
[F4(5)In this section “religious group” means a group of persons defined by reference to religious belief or lack of religious belief.]

Umm, all the paragraph that you pasted is doing is defining when an offence is considered racially or religiously aggravated and is in no way supporting the 'racism is illegal' argument.

Yeah. What spud was talking about is effectively thought-crime, is not illegal.

If these thoughts then manifest themselves as actions, the actions can be deemed illegal, but not the thoughts themselves.

I can gurantee you would care what people said about you if it grew out of control, starting trending or became the cool thing to jump on.
It would definitely affect you one way or another. How about if someone starting randomly tweeting awful, unjustied words about any of your loved ones, are you suggesting you could just move on and forget about it?
I'm guessing you've never been bullied?

This thread demonstrates a perfect clear line between those ocuk's members who truly believe in liberty and those who believe in tyranny (but possibly don't know it yet).

oh and **** the police state, the police should arrest business men with suites who steal tax money and not some stupid ass hole with ****ed up comment on stupid site.

waste of time / resources.

Yes quite. The act of racism is illegal (a mind is free, so thoughts do not count). If you shouted in the street "**** OFF *******!" Then you could be arrested for a racially aggravated s5 public order offence.

If you shouted in the street "**** OFF ******* im going to batter you" then you could be arrested for a racially aggravated s4 public order offence.

Fully star out all swear words.

how can it be justified when a few weeks back a gang of somalian girls beat a girl up whilst billing her a white bitch and as they said they were drunk and not used to drink they got suspended sentences.

the thought police are at the door got to go,,,:-/
