Help! Courier claims to have delivered, but I have nothing.

Hi guys,

having ordered some bits and pieces online, I've checked the web tracking and apparently it has been delivered. The company I ordered from apparently have a siginature, but nobody was home that day.. I've confirmed that.

Where exactly do I stand legally? Do I take it up with the courier, or the store, as thats who the contract is with?

Take it up with the store and find out who signed for it. Perhaps phone the courier depot if you think it's easier. Maybe a neighbour has it.
 
Ask for a copy of the delivery/consignment note. Compare signatures. A lot of them ask for a name to be printed and signed for so it should give you an idea of who it was. If obviously its your name but a false signature, a copy of a drivers license or passport.

Contractually, the courier is acting on behalf of the seller to deliver an item to a person(you) to an address(specified by you). If they deviate from either the person or the address without consent of the sender then they have broken contract and are liable to replace the item or compensate you for it.
 
This happened to me all the time with Intercity :@ made me so angry...
the drivers were just lazy and theives.

They said they left several cards but never did, they signed the packages on several occasions ... and at my guess just made off with the items themselves.
 
You dont do anything to the courier.

You ring the supplier as the contract to supply the goods is with them, and the contract to deliver the goods is between the supply and the carrier.

You tell the supplier they have failed to supply your goods and demand statisfaction from THEM NOT the carrier, that is the suppliers problem.

I have called both the shop, and the courier. The shop, as said, have given me a screenshot of city links POD, and its just a scribble. I've checked with the neighbours, and they have not signed for it.

Citylink say that they went up the path, and there was apparently a man in the garden who they think 'might' have been a neighbour.

Am I within my rights to cancel the order and demand a refund while they sort this with citylink?.. I've already had to wait almost a week for them to get it in stock, and it really does need replacing.

I had a problem like this with initial city they let some on else sign for my parcel. It was a dell monitor they was delivering. I got the yellow slips and it was some one called patel who signed for it.

To cut it all short i got in contact with tradeing standards they said to me if i paid by credit card i could claim it all back of the credit card company. If i didnt i still had a leg to stand on as they let somone else sign for it and it was no any one That had my second name.

If you didnt pay by credit card then get in contact with the seller and tell them that you havnt recived your parcel and what ever else then you should be able to claim they money back through there insureance company. The sender has to claim it though you cant do anything.

I've just spoken to the retailer again. They are saying that they will not / can not refund or dispatch again until they have been told by citylink that they will also be receiving a refund.

Is this right, surely the responsibility for that is on their shoulders, as my contract is with them?

I wouldnt be happy with that, end of the day you paid the company for the product its not your fault their courier of choice failed.

Seconded, not your fault if the courier they used screwed it up! That's poor customer service :(
 
So they got someone to sign for it who happened to be OUTSIDE your house on your garden path - it could have been anyone. So are they saying that they didnt actually knock on your door, but just got this person to sign for it as they assumed they lived at your address / was a neighbour.....................If they got a neighbour to sign for it they should have also left a card to say thats what they had done aswell as the house no. of the neighbour where they left it.

Yes they should but when i asked trading standards that they said they could send you what ever you paid for but they dont have to because they might not get any money back from the insureance but if they did just means they really value coustomers
 
If the OP still can't get anywhere, and he can't set his Credit Card company on to them (for whatever reason) go to the Citizens Advice Bureau. They helped me out when I had some problems with a well known company.

It will be in clear breach of their T&C's to deliver to someone "outside" the property who they "think" might be a neighbour, they have not fullfilled the contract to deliver the goods and obtain a clear signature, tell your supplier if your goods are not delivered to you within a period of time that you decide is acceptable you will contact your credit card company and get your money back (the CC will have no problems recovering their expenses from the supplier) or trading standards.
 
Only ever time I had problems like this I mentioned it to my CC company who were onto them in a shot, sorted it same day. It's amazing the influence they can have on a business which relies on CC facilities for taking orders :D
