How can't you have a TV licence?

No you don't.

The law states that you need to be covered by a TV Licence if you watch or record television programmes, on any device, as they're being shown on TV. This includes TVs, computers, mobile phones, games consoles, digital boxes and Blu-ray/DVD/VHS recorders.

You don't need a licence if you don't use any of these devices to watch or record television programmes as they're being shown on TV - for example, if you use your TV only to watch DVDs or play video games, or you only watch ‘catch up’ services like BBC iPlayer or 4oD.

If you have a PC and intend to watch live streams (regardless of any "delay") you need a TV Licence. Bare in mind this is per house-hold - so one TV Licence in a house-hold will cover any and all TVs / PCs.

All of your post sums it up quite well. The only thing I'd raise as a potential issue is the bit I've bolded. I believe that you're right if all members of the house are on one tenancy agreement, however technically, if you're on separate tenancy agreements, you technically need your own licence.

because you did not read the law correctly, you believe the law says something different to what it actually does.

The FAQ and the law are in complete agreement.

it doesn't... you're just misinterpreting the law

The law does not mention the word "live" at all. Even if I am misinterpreting it, it certainly doesn't have anything to do with the 'live-ness' of the stream you are watching which is what is being peddled as fact in this thread.

If you buy a TV with a self contained tuner, you will have your details taken by the retailers and this will be passed onto the TV licensing people.

Buy a TV without an inbuilt tuner or a monitor and you're fine.

yeah if you've got a lock on your door you live in a seperate "household" with shared utilities i think.

and if you have a TV with a tuner and it's plugged into your PlayStation not an aerial and you don't use it for watching live tv, then you can happily have the inspector round he will look at it go "ok" then **** off.

I try to keep these little outbursts to a minimum these days but I just can't keep this one in.

WHY WON'T YOU JUST ACCEPT THAT YOU ARE WRONG YOU'RE MAKING YOURSELF LOOK FOOLISH

It's literally been spelled out for you with a proper source, straight from the horse's mouth so to speak, but you're making stuff up and writing it down in an authoritative manner like you think it will trick everyone :/

It is confusing - I had a letter recently which effectively said; "you will need to own a tv licence if you own anything capable of tuning into live tv - this includes a computer, games console etc'.

The way it was worded made it seem that even owning it meant you had to have one, even though on scrutiny it didn't necessarily have to mean that.

They want people to think they require a TV license because they want as many people buying in to it as possible, so they like to word things in an ambiguous manner to confuse people.

Making your text bigger doesn't make what you're saying any truer.

I have quoted what the Communications Act says, why you think an FAQ from a website overrides that I don't know. How the TV licensing people enforce the rules is up to them but that doesn't make the rules any less true.

well read this bit:

(3)
References in this Part to using a television receiver are references to using it for receiving television programmes.

So if you aren't using it for that you aren't committing an offense .

no you just don't understand the law... yes if you plug in an Ariel and tune the thing in then you'd potentially be in trouble... you'd be installing it and receiving broadcasts

If you buy a TV and just use it for your playstation etc... its not a problem
