How to get out of a contract?

Well basically i am with the wonderful 3 network providor. Was going to cancel my contract as it ran out a couple of months ago. Stupidly i let them talk me into taking out another 18 month contract with them with a new phone, nokia n97.

The guy pretty much said the phone was better than the iphone and told me a whole lot of stuff that it pretty much can't do. The phone was ok the first month or so, but i started to notice problems with it, always crashing, got really slow, has quite a lot of things that bother me about it really, and to top it all off it just died on me last night. Screen went wonky and broke, i never dropped it or anything. Im pretty sure nokia discontinued the phone aswell, atleast 3 don't seem to be selling it anymore.

Also i have never really been able to get a signal in my area, even though its supposed to be excellent coverage.

Just wondering really if i have enough valid points to be able to get out of this contract? Maybe terms of mis-selling the product? or atleast get a new phone with the current contract.

Any help of advice would be appreciated, cheers.
 
I doubt it very much if they will let you out of the contract...unless you pay up ie whatever the amount is after 18mths.

If anything they will offer to repair or replace the phone if its faulty..but they wont cancel the contract as hard as you try.
 
Never say never - I took out an 18 month contract with Vodafone with a new N97 in August of last year.

Last month, Vodafone removed the minimum term from this contract which has allowed me to upgrade this month to a HTC Desire :)
 
Well obviously if the contract changes in a detrimental way then there is your get out clause.
But generally speaking in this case their argument is going to be that deciding the phone isn't for you and signal issues - 2 months is a long time to wait and complain.
 
I would read the T&C of the contract and see what clauses there are; you're probably going to have to buy yourself out of it though.

really how did you manage that.

my wife just lost her HD2 and really wants the Desire now.
 
I managed it by arguing that the N97 was inherently faulty and that none of the replacement options they offered me were suitable.
 
Would I be able to cancel my contract with Vodafone if they mis-sold me my contract?

They confirmed it was an 18-month contract when I took it out but they are now saying it's a 24-month contract.
 
surely it will say 18 on the contract you signed ? either digitally or through the post ?


OP you dont have much chance tbh. will take a hell of a lot of arguing/moaning

god knows why you took out another contract when you struggle with signal in your area

What was wrong with yours Fox ?
I'm on my second N97 and this one is just as bad.
Signal strength is up and down like a yo-yo, a lot of the bundled apps simply dont work, phone locks up sometimes etc etc.
I phoned vodafone today and spoke to a guy who really didn't care.
He ran some sort of signal strength tool :rolleyes:
He said it was because we recieve a bad signal in our house.
I informed him that my mate has had his iphone sat next to my N97 and he gets full 3.5G in our house.
He just said take my phone to the vodafone shop, and see if they can send it away to be repaired.

If you dont it over the phone then they wont send you any forms to sign for the contract lol...its basically a verbal agreement they then send you the phone and you have either 7 or 14 days in which to decide to accept the contract or send it back telling them you dont want the contract.

Seriously unless you pay up the remainder of your contract they are not going to cancel it...simple as that.
