How to handle a sale and deposit situation.

Hi,

I am advertising my car, and had a few offers. I accepted the 1st one for £50 under the stickered price and took a deposit. Now I have a persitant guy who is offering £50 over the sticker price and £100 over to break the existing deal.

So whats the best course of action... Tell the buyer with the deposit that a deal breaker is on the table and to offer more or possibly loose the car?

I am not 100% sure how much the deposit guarantees the car's sale.

Technically could be liable for damages?
 
Legally you can tell the original buyer to get stuffed...*

But morally.. it's pretty low! Gentlemans agreement and all that. So it's up to you :)

Actually had an exact same problem come up on the gti6 owners club recently. A member agreed to sell his car to another member, then the guy who was selling had a higher offer so accepted that afterwards. Needless to say the member who was going to buy in the first place was rather ****ed off. :(

*Pretty sure I'm right but don't take it as gospel... And you have to refund him the deposit obviously :p

If you've taken a deposit and given your word, it would be pretty low IMO to sell to the higher bidder. I guess it depends how much you need the £100 :).
 
The first guy has probably went about swapping his insurance over and advertising his old car. It would be a right kick in the teeth if you told him he wasn't getting it.

Legally you have the choice but do the decent thing and give it to the original buyer. :)
 
Guys, I am gonna go with the 1st buyer, she even gave up a job interview to look at it.

TBH It is a £750 car, which the 2nd guy said that he would go upto £1100 - but I would feel ultra guilty about selling to him.

She called at 9:30am and when I went down to move the car at 10:30 she was sitting behind it - Probably guarding it.

So thats that - it is hers and I can sleep at night.

Jeez I thought buying a car was stressfull!

I never thought I would have a bidding war over this.

when i sold my avanzato i had it up for sale for something like 3months and in the end sold it v-cheap to a friend of Vanpeebles off here, two days before he was due to buy it someone rang up out of the blue asking to buy it for the origenal price! the extra k would have gone down well but felt so guilty about ripping off a guy that had his heart set on the car for ages i sold it to him :)
