Some of you are already aware, but I am in court tommorow to answer to two summons that I received a month or so ago.

The story begins back in May 2006. I was caught speeding on the M1, by a marked car. I was caught over a distance of 0.387 of a mile at 89.02mph. (VASCAR)

The plod who caught me was fairly decent, we sorted the fixed penalty notice pretty quickly. Then he let me get on my way.

Later that week I rang up and paid my fine over the phone, and ordered a new paper part of my license as I had lost my old one. I then called the ticket office to explain that I had to order a new license, they said this was fine and as the period to present it to a police station would have expired could I send it directly to them. I agreed.

A week later, I sent my license off to the ticket office and considered the matter closed.

This was in May, then in August I received a letter from HMCS saying that Nottinghamshire police had requested that they refund all fines paid in relation to the offence. No more detail in the letter at all. At the time I posted on here, and we thought that I may have been let off.

I hadn't, I spoke to the ticket office to query why HMCS had returned the fine, and they told me that they hadnt received my license. I said I could order another and send it in, but they told me they were no longer dealing with the matter and that it had been refered back to the issuing officer and that they would decide what to do next. I left it, assuming someone would contact me.

Then a month or so ago (Oct) I received two summonses. 1 for the speeding offence which I intend to plead guilty too, and one for failing to produce my license, which I am going to plead not guilty too.

My reasoning is this. Why would I order a new license in May if I wasn't going to produce it (I have a receipt from DVLA as evidence), AND why would I declare the points on my personal insurance (taken out in July, again statement of insurance shows this as evidence.)

Im hoping this will be enough to allow the magistrates to agree with how I plead. I can't help but think its all really silly, and a total waste of court time. All it would have taken is for the ticket office to agree for me to resend my license, or to have contacted me to let me know they hadnt recieved it. Instead I get cryptic messages from HMCS.

GRRR.. Wish me luck anyway.

Good luck, any magistrate with half a brain should see this is a maistake and a waste of his time...

Looks like he has a problem then :p

Good luck, i feel all should work out since you have printed evidence.
 
They will more than likely drop the S172 charge, id be very very surprised if they even gave it a second look seeing as you have applied guilty to the speeding :) Good luck with it. Hopefully will just be a 3 points + £60 + £35 costs.

The costs is really gay tho Jez :(

I shouldnt even be paying them, I know im guilty but its friggin stupid. I paid the fine back in May.
 
You can appeal against costs, in all likelyhood you should win too. Did you actually reply to the summons at all? I believe the chance to appeal against costs is on that reply.

No didnt reply. Most likely my downfall.
 
Conclusion:

On speeding : Pleaded guilty, found guilty.
60 pound fine and 3 points. No costs.

On failing to produce license: Pleaded not guilty, found not guilty.
No costs.

Best result possible :) I looked the magistrates in the eye. Acted like a gentleman etc.
So many people at court in jeans and a going out shirt, was funny really.

Anyway im happy with the result, and it took the magistrates a simple nod to each other to decide what I got. I think they thought it was a waste of time too.

CPS guy did try and get the case adjourned so that he could get further evidence from Nottinghamshire police, but the court came to the conclusion that it was a waste of time.

Slightly off topic but as a scientist I find it hilarious that the speed was quoted at 89.02 without any indication of error! Vascar works by pushing a button and timing you between two points so to suggest it can be accurate to 0.01mph is credulous.

He used a bridge shadow and a lamp post as reference points too.
 
Ex-girfriend had to go to court for failure to produce her licence. She had parked her Mini on a pedestrian crossing :rolleyes: and a plod told her off and gave her a producer (had no documents with her). The only problem was he ticked the box for a HGV licence and she had to go to court when she didn't produce one at the police station :D . She had to take a day of work and attend court before they agreed it was a load of ******
