"I have a full time contract but have Mondays off holiday question?"

This is more for my curiosity than a moan.

I've seen my employer go from a small team of 3, and growing to 17 full time employees. From day one he has always given all his staff 28 days annual leave.

Talking to a few friends, there seems to be a split of those who get 28 days holiday regardless of their days off, and those who get 20 days off, and then the bank holiday days are incorporated into their annual leave.

So I was simply wondering, legally, what must an employer pay for annual leave? For those that work a bank holiday against those that don't (For full time member of staff)

Is it simply down to whats legally accepted in the contract they sign?
 
You are entitled to your 28 paid days legally, that doesnt matter if it includes bank holidays or not.

If some get 28 days on top of bank holidays, then its a bonus to them (double bonus if they are paid as well).
 
As others have said you get 28 days paid leave. Most places I’ve worked include the bank holidays in the 28 days.

My current employer gives me 23 days holiday and all bank holidays off so come out better then the 28 days minimum.
 
Im one of the few at our place that get 26 days off plus all the bank holidays. Any new people get 23 days all depends on your contract.

We get more holiday the longer your here so we have some people on 30 days holiday plus the bank holidays. If a bank hoilday falls on you day off you get either paid or day in lieu, a few of the people choose Mondays as their rest day and claim the bank holiday in lieu so get an extra 5 days off giving them 7 weeks off.
 
25 days seems to be quite common IME, 20 days seems a bit tight OP you're basically getting the bare minimum holiday allowance excluding the bank holidays you're entitled to
 
You do not get 28 days legally, you get 5.6 weeks.

If you are working 5 days a week, then 5 x 5.6 =28

If you work less than 5, or call sick, it can be re-calculated.

So in theory, if you call sick a single day or are late (even a minute) you will loose that 28th day of annual leave, as it will not be a whole number anymore.

Overtime counts in annual leave.

You cannot round down, only either round up, or pay exact amounts

surely you could claim some sort of indiscrimination of some get extra 8 but not others?

Only if you can show it is done as a form of discrimination, you are entitled to your legal requirement, anything over that comes down to your negotiating powers and your contract.

Obviously if every white employee gets 28 days inclusive and every black employee gets 28 days exclusive, then thats an issue.
 
I used to get 23 days plus double time for all bank holidays if worked, but now I just get 29 days as the incorporated the bank holidays into the normal holidays which is good I think because you can choose when to take them.

In a company with dedicated HR team you can often negotiate being on unpaid leave in order to take the paid holiday later, or vice versa.

Huh?

If the place is closed, why should you be forced to take your holiday allocation?
 
28 days off + bank holidays + extra 2 days every six months if you are not ill.... Not bad at all.

That sounds a bit dodgy - is it a large employer? IANAL but it seems like someone with a disability which might require time off sick to attend hospital or just recover from their condition etc.. could claim that is discriminatory.
