I Think My 360 Is Broken

I'm on my 5th 360 at the moment and it's the Elite which I got less than 2 months ago after my premium started to go funny.

I've just been playing PGR4 and was about to starts another arcade race and heard this sound coming from the drive which can only be described as a farting/grinding noise, not terribly loud but definitely noticeable and of course the race wouldn't load, at this point the blade popped up saying the disc was dirty etc.

Took the disc out right away and there were no mark or scratches on it at all. So put the disc back in and again it made the farting/griding noise and it said "Open Tray" on the dashboard. turned it off for a bit and tried again with 3 or 4 discs and it does the same.

Broken for sure??

It's annoying to say the least.

I've fixed it. I lifted the front of the 360 a couple of inches and then dropped it. Now it reads discs.

Hmm, sounds like a recipe for scratching discs next if you've knocked bits loose in the DVD drive or something!

I agree. But I know if I take it back they will test it and see that it actually works and send me packing. I can't prove it has a fault anymore :(

So are you saying I definitely should take it back? It's only happened the once. Also it was a replacmeent for my Premium that was bought in January. Do I still get a brand new years warranty with the Elite?? I imagine I do.

Yes you do get a new year/3 year for rrod warranty with the new console. Definatly take it back, or you may find in a month or so all your discs are unreadable due to scratching and then you have to return it anyway.

I just popped in to the store on the way home and at one point the (very fit and polite) girl on the customer services desk says yes we will exchange the 360. Then one of her colleagues piped up and said no we will send it to M$ for repair because its over 21 days old.

I argued that this was against the sales of good act at which point the bloke behind the counter got a little arsey and said it was MS policy and that was that. I know they are wrong but couldn't be bothered to argue anymore without proof. Especially as they say they have no Elites left in stock locally in any of their 3 stores. I said I would be wanting a refund in that case and will probably be back later.

So, I need one of you clever/informed types to point me to the precise documentation on the SOGA that gives me the backup I need should they get twitchy when I return it.

I really don't want to have to go the refund route because I will have to give up my HDD and lose my save games. Slightly annoyed tbh.
