Do you have to tell them how you got their address?

I bought a book off ebay in September. Long story short they never sent it. User has a bad track record of doing it but no one could ever do anything otehr than an ebay/paypal dispute.

I couldn't do either because it's been months and ebay and paypal have a time limit.

So I took them to the small claims court for £3.98.....and £30.00 court fees of course :)

Now. The person was always sly. He would say postage was First Class recorded but would always post second class. No one was able to get his address....but I was.

If he asks via the small claims court somehow do I have to say how I got his address? Or can I refuse to answer?
 
The guy had thousands of sells but only a handful of buys (three in fact). I asked a user he bought something from. The user was sympathetic after I explained the situation and gave me the address he posted the item to.
 
Fair enough, was just worried that handing out someones addy might be against some kind of rule.

Even if it was I still wouldn't say where I got it.
 
The person you have gotten the information from is the one that could be legally wrong. He has breached the obligation of confidence between himself and the buyer by telling you the information. It may also be against the rules of the site to divulge such information.

Ultimately, i cant think of any consequences for you from this method of getting his info.

After an eternity (3 weeks) I got a cheque back for £33 :)

Great stuff matey, nice bit of detective work you did :D

I stopped using scumbay ages ago as I found to many scammers.

Vanilla, could you give us a rough outline as to your story with the purchase that went wrong and the procedure you went through to take this guy to court.

I think what you have done is something I shouldve done when I didnt receive a camcorder I paid £130 for.

A lot more of us should be following your strategy as this will discourage people from making bad sales.

Do as Matt-Page suggests and contact everyone else he as ripped off and tell them how to proceed. His address is now in the public records as a result of the court case.

People that do nothing in these situations only add to the problem. You gotta take the situation by the balls and do whats right, even if it the returns are low.
 
To other people in the same situation!

You can email ebay and they will send you the name and address (usally phone number too) of anyone you have bought or sold an item too. Helpfull.

Will find the link latter.
 
I think if you offer to pay by cheque, a receipt is displayed which you are supposed to print out and send with your cheque. The full details (including the address and phone number) of the seller are also displayed.
 
OK, the story. In summary -

Bought a book off some guy in September. He was some kind of book seller, only ever sold books, 2000+ feedback, etc. Two months later I was looking through things and realised I never received it.

Mailed the guy and he said I would have it in a few days.

Weeks later and no book. Mailed the guy and got no reply. Kept mailing, got no reply.

Too late to file via ebay or Paypal (limit of 6 or so weeks!).

Still no reply to messages. I leave negative feedback. He leave retaliatory negative feedback :mad:

Now i'm mad. This guy is clever, although on his auctions he says he will send recorded he only ever sends second class so no one ever gets his address. I notice that he had used his account for 3 purchases. I contacted each of the sellers and explain the story. One guy got back to me and was sypathetic - he then gave me the guys address! Result!

I filed small claims online - https://www.moneyclaim.gov.uk/csmco2/index.jsp

Paid £30 court fees. I asked for £33.98 back. £3.98 for the book, £30 for fees. So now that book he failed to send cost him £33.98.

Aha but that's not the end!! I have taken it upon myself to message everyone who left him negative feedback along the lines of 'book not received'. I have given them his details. Some people explained they had received a refund through paypal, but around 6 were like me!

They have all been waiting to find out how my case went (no point in everyone shelling out £30 court fees to find the guy isn't going to pay or the address is incorrect!). I've now messaged them and he should find another 6 lots of £30 court fees to pay :)
