insurance help..

as some of you may or may not know, my car was reversed into last week. My car was stationary for ~30sec previous to the impact, I was in the car, the car who reversed into me reversed off the pavement, after being half parked on it, started reversing, and there was nothing I could do about it.
Now I have about four witnesses who saw it, and they all say definitely the other drivers fault because I was stationary before he started reversing, is this right??
I need to make sure I wasn't in the wrong before I start going through insurance, as I don't fancy paying my hefty excess if they decide it was actually my fault.. somehow..

any help appreciated.
 
You're 100% in the clear, don't worry about it.

Are you making a claim directly against his insurance or going to your own first?

Because if you go straight to his insurers you wont have to part with the excess, whereas if you claim off your policy you will have to pay the excess then claim that back from his insurers which may take a few weeks.

well he won't give me his insurance details !! he offered to get my car repaired for me with a second hand door and some body shop in sparkhill, I said I don't think so, plus I need a replacement car for when mine's in. So he said I'll just have to ring my insurance to get them to contact him to get his details :mad:
When I spoke to my insurance (no details of me given) they said I shouldn't have to pay excess, but if the guy tries to say it was my fault - even though there was no damage to his car, I will have to pay my excess.
I will be ringing/visiting the witnesses tomorrow though so fingers crossed all goes well, but they all approached me and said if I need the help then they have no problems helping.
 
I highly recommend from experiance going down the route of going direct to their insurer.

For both my bumps (one the other party clearly in the wrong and got in trouble with the police, the other clearly in the wrong but denied everything) I've done this and I've not had to part with a penny of my own money, and most importantly my insurer never had to pay a penny for anything.
