Interesting situation... what would you have done?

One of my mates works as a call-out engineer for a local data centre. He was restoring a dead HDD when he found literally TBs of pretty violent child porn. At the time he asked me what to do as he wasn't sure, although he probably just wanted to let me know some gossip. In the end he decided to tell the data centre before the Police (fair enough, they need to know anyway and it's in his interest to keep his clients in the loop and happy).

As it transpired after he told the centre owners, the rack space was actually a co-location and was being rented by an individual. However, they pleaded with him not to tell the police and let them handle it, which he obliged to assuming that once steps were taken they would inform them of the crime.

A few months later and he was chatting to one of the on-sites and was told that the incident was never forwarded on because the owners didn't want to potentially instigate a full investigation on the centre. So now there's some guy out there potentially part of or helping to aid child pornography because a company was too chicken to hand in an oversight to the police.

When I was told about it I had some pretty strong opinions, mainly that the company is pathetic for worrying about a situation which probably won't even happen just to assure themselves of not getting audited. But also for my mate who didn't persist about it out of fear of losing a client. I personally would have gone over their heads and told the police, even if it meant losing a contract.

What would you have done?

Told the police in the first place. The company have now potentially committed a crime covering this up I believe?

violent child porn ? hmmm why dont u phone the police and tell them the whole situation. giving your friends details and those involved.

Can you not anonymously tell the police that there is child porn there - and get the address off your friend, call from a phone box etc?

That's what I thought, and besides they should have been monitoring their rack space anyway to ensure no illegal activity was happening. According to my friend some of the stuff had been on there a good few months. It got me wondering if they wanted to avoid investigation because they have other things to cover up.

I am pretty tempted to report them myself, but don't know the company.

Yeah well as I say I'm tempted to do it, only problem is I don't actually know the company or location as my mate just said it was one of his clients. He knows I've got a strong opinion about it so is probably gonna be a bit suspicious if I ask him who the company is.

He works up and down the south east too so it's hard to even know. Really getting me fustrated though.

I'll make your opinion even stronger,

Imagine if it were your kids this guy was publishing videos and pictures of? Your friend has technically committed a crime for allowing this to carry on, the fact he saw and hasn't said anything is perverting the course of justice. You've got common sense I'm sure, use it :).

Well following that logic surely you must report this article to the police now too?

report it, your friend will get dragged down with it, if the police ever find out about it and knew your friend didn't report it. Just make a tip, and don't give a name. That way the company could assume it was one of the employee's or something who had discovered it (seeing it was months since they had done buisness with your friend, and so they'd assume he had forgotten).
