iPhone4 - Can I (legally) create a wireless network for things to connect to? (Orange)

From what I can tell the phone is capable of this, but it's been blocked by Orange/Apple?

Just sold a mate my Touchpad & he wants to tether it.

That's the thing, they only offer it to business customers.

Seems daft having to have a tethering bundle when you've already got a data bundle!
