Issue with another retailer, the product is faulty but has since been discontinued

So I bought a Samsung TV with another retailer, the price was fantastic at about 50% less than anywhere else. Upon receiving the item, the scart socket was faulty which meant I couldn't pick up a signal from an old Sky box. I decided to return it to the retailer.

Since doing this the product has now been discontinued. I have therefore been offered only 1 option - a refund. I have explained that I understand the TV is discontinued but replacing it with something similar would cost considerably more. No joy, only a refund.

I am beginning to think I would have been in a better position if I had cut the retailer out of the loop and sent it back to Samsung myself for a repair. Perhaps they would have replaced it with an equivalent product.

The retailer in question seems hell bent on giving me a refund, is there anything I can do? I have even suggested that I am happy to wait if they were to return it to Samsung on my behalf to sanction a repair. They don't seem to want to budge.

All you can do is ask them to send it back to you and ignore your initial request. You can then either ignore the broken scart by getting a proper sky box, or send it to samsung yourself. They are within their rights to offer you a full refund only.

So you bought something cheap, it was faulty, sent it back, now want the retailer to offer you something other than a full refund? something that you have said would cost them money.

Am I the only one confused as to what you were expecting?

This is what I am hoping to do if all else fails. I expect they will want to charge me for returning it to me, however.

No, I am asking if they can sanction the repair with Samsung for me. I'm not expecting them to offer me an equivalent item at a loss I'm just hoping to end up with the same TV that I bought even if I have to wait some time to receive it.

not sure really but you may have something under the "loss of bargain" laws

Not heard of this, I will have to look into it. Cheers!

Do you still have the telly?

Unfortunately not, it's with the retailer as we speak. I only had it out of the box for 10 minutes before realising the scart socket was faulty. If I had realised it had been discontinued I would have contacted Samsung directly but I wonder if they would have referred me back to the retailer.

You would have a manufacturers warranty which you could have invoked by delaying for a month so its out of the retailer's hands. As for getting it back now, try telling the retailer you want to cancel the instruction, make up a story about how you won't need to use scart on it (if it has HDMI etc). I don't see why they would have a problem with simply returning a faulty item and not having to put their hand in their pocket...

Oh no wait he is, law is crazy!

This is the risk with bargains, some go through smoothly others sell out, are maybe returns, etc.

I don't know why you find this funny, this law actually exists but it would seem that the retailer has fulfilled their part of the contract. I'm not looking to sue anyone, just looking for helpful suggestions to plead my case.

So far asking for the TV to be returned to me and using an adapter/arranging for a repair with Samsung seems favourite.

I think your only option is to get the retailer to return the screen to you (most likely at your own cost). Then you can contact Samsung directly and arrange a repair under warranty.

I always thought svideo was the best quality, and scart / composite (yellow) were the same quality. I've never really looked into it mind :)

my mistake - those adapters go to composite, not s-vid. anyway, it goes S-Video --> Composite --> SCART (RGB) in ascending quality. :)

RGB via scart is better than s-vhs.
Samsung (in my experience) should repair the TV in a short time, and it wouldn't matter if it's out of warranty.

I suggest calling the retailer and asking for the TV back - you could even offer to pay for delivery if you're sure you wouldn't be able to get a similar deal elsewhere.
