The kid was a cyclepath!

For those of you saying how can one bike get away scot free and the other not need to go back to school and study physics.
Also road bikes tend to get lighter the more expensive they are. I reckon that on my all mountain bike I could plough through fields of kids on BMX bikes whereas my road bike would collapse into a pile of bits.
OP you can't do much but claim on your insurance. I'd have been tempted to headlock the kid if it was me but I love my bikes more than most things...

Manic needs to be knocked down a cog or two, I should do it in fact, I have a black belt in Shimano.
I'm not happy.
I just got in from cycling home from work. While on a busy 2 lane road this kid pulls out from the pavement behind a bus stop shelter out of no where - without even looking!!! and stops right in front of me! I braked but the idiot was too close for it to have any affect and sent me flying over the handle bars!
now I'm not hurt or anything, but the kid was 15. I took his details but what good is it, I can't claim for a broken bike as his bike is fine!
I assume I should just claim off my insurance?![]()
How fast were you going at the time of the incident?
Was the incident one which was totally unforeseeable from your point of view?
How long did you have from the time he pulled out until you went over the bars?
Road users have a duty to one another, and as such if the facts are that you were in no way contributing to the incident, you would indeed have a claim in Negligence.
However, you have to consider:
1) Is it really worth pursuing?
2) Can the kid actually pay up if you take action against him?
they are pretty cool

If you had a proper bike you could have just plowed through him (in a non-peverted way of course).
