Mix Up Over LCD TV - Advice Needed

Ok guys,

The story goes like this....

25/05 - New LCD TV Arrived - TV was faulty
25/05 - Called repair company who agreed to collect for repair on 26/05
26/05 - Company never showed, called them and they advised me to go through the retailer that i purchased from as it was such a short time from recieving the item.
30/05 - RMA recieved
2/06 - Faulty set collected by retailer
13/06 - Replacement set arrived - TV was faulty
16/06 - Managed to speak with companys UK Rep who arranged for me to recieve a replacement TV next day (saturday)
17/06 - Replacement recieved - TV working great.

My dilemma is that i still have the faulty set in my house.

The fault is that when connected to a PC, and the PC is rebooted then it will not give a signal, all you need to do is power the TV off and then back on again - so it in theory aint a major fault...

What are the legalities of me keeping this TV?

Nobody has called to ask for collection and no couriers have arrived.

What should i do?
 
Keep it till they ask for it, OR tell them you have it and give them one month to collect it before sending it to me.

after all its their mix-up, should i really bother telling them?

i was thinking of keeping it 3months then selling the good one, the inconvenience of having to turn it off and on when the pc is rebooted aint too difficult really...

I wouldn't mind that if you could claim for storage, damn sure any company would if you ask them to keep stuff for you for 3 years :D

Was another similar thread on here a few days ago, if they do not collect the item within 6 months it is legally yours.

However I think you have to ring them to ask for them to pick it up.
 
The easiest way is just to call them.
Explain what has happened and give them a month to arrange collection and that if they haven't arranged collection in this time you reserve the right to dispose of the item.

This way you've done the legal bit required of you - you've informed them that you have this item and it is entirely in their hands as to what happens next.

If you sell it and then in 5 months they come asking for it back, well I hope you kept the money you made from it for that amount of time.
If you didn't, you may just as well keep the item for x months until you are sure they have forgotten about it.
