Arrived at the court today and was really quite nervous.

Session started at 2pm and the usher came out to tell us that one of the court rooms had been closed and that we would all be heard in one court so expect to wait!

As more people started to arrive I realised that I was the only defendant in a suit. There was nobody in shirt and tie, infact nobody else even had pants or shoes on just jeans or trackie bottoms with trainers!

Eventually got arround to my case and as I entered the court room and I was bricking it! There were two magistrates both female and around 50-60 years old, neither of them looking particularly happy!

The prosecutor read out the statements and then the magistrates must have repeated about 4 times that they could give me a 2 month ban :cry:

I said my bit, showed them that the car had been insured in the past, showed a copy of the RT advert and also provided 10 original insurance certificates which cover the last 4 years for various different vehicles.

They went away for a short while and whilst they were away the prosecutor said how shocked she was at how unlucky I had been :| :lol:

They came back and gave me the news... 6 points and a conditional discharge for 12 months + £35 costs, not fine :)

They said I was very lucky and that it is very rare for them to do such a thing!

I'm pretty happy - oh and no increase on the insurance until renewall :D
 
What exactly is a "conditional discharge"?

Sounds like something that you really wouldn't want your doctor to diagnose :p
 
Just guessing, but would that be something akin to a suspended sentence, ie no further punishment as long as you are not caught for anything else?

Hmm, not so sure about the good outcome. For "thinking I had DOC on my policy but actually didn't" I received a 12 day ban and £35 fine (IN10).

I had this too. If I was caught for any other offence within a 12 month period, they are allowed to review this case and prosecute further if they so wish
 
No, there isn't, any fine or sentence is entirely subjective depending on who you have on the day

6 points is the lowest possible sentence for a IN offence. I have been reliably informed by a magistrate of this.

Costs are about average although it was within their authority not to add costs because you'd been brought to Court after pleading guilty by post and at their behest.

As you will no doubt be aware, 6 points is the minimum.

Altered my premium by about £70 for the first year. I preferred the ban as two further speeding offences in a 3 year period equals :(
