Need help with getting warranty claim on car sorted!

As soon as the car is sold on to you Gibbo the paint issue DOES become their problem. What happened before to the car that they did not notice is no defence. What would they say if it was two cars welded together? Would they again say it was previous owner so it's nothing to do with us? LOL, I'd like to see a dealer try pull that one.

Forget about warranty issues - the fact is they've sold you a car with a botched paint job. The whole warranty issue doesn't come into it.
 
1. Car previously repaired hence voiding the warranty on that section of paint on the bodywork.
Keep telling them this is immaterial as you accept the warranty was voided before you purchased the car and as such it is no defence at all to your claim.
2. Car was sold as a used car and as such had 3 month warranty bumper-bumper and as this issue did not arise in that period its not covered.
You were right to say that this is tosh. Remind them that the Sale of Goods Act does not care one ioata about the time limtations of their three month used warranty if it does not meet their statutory obligations under the Act.
3. As Mitsubishi or the dealer were not aware it had a previous repair to the paint Mitsubishi won't put it as a warranty repair and the dealer is unwilling to pay for it.
By admitting they are unaware of the quality of the paintwork or the status of the warranty they are, in my opinion, admitting they did not establish before sale whether the good was of 'satisfactory' quality. This is because for a 2 year old car to be of 'satisfactory' quality it must have paint that will last more than a year and it must have it's original warranty in tact. There is no way on Earth the dealer could argue in court that it is 'satisfactory' for the paint to vanish after a year (this is why and how cars are offered with decade-long paint warranties) and it is 'satisfactory' to have a key reason for buying a car of it's age missing i.e. the warranty.

You also have another potential trick up your sleeve. Tell them when you bought the car you asked if it came with the Mitsubishi warranty. Say you were told "Yes". They cannot argue they said anything else, as they have admitted to not knowing it was invalidated before selling you the car. In that case not only is it not of satisfactory quality, it is mis-sold.

I would get them to put their decline to repair the vehicle in writing. Then, once you have it, tell them you are going to sue them if they don't resolve it immediately.

Well they never got back to me this afternoon and when I chased them up the manager had gone home, really not impressive level of service.

So based on what Brighton Mitsubishi have told me and you guys here I shall be requesting the following tomorrow:-

1. For Holdcroft Mitsubishi to put in writing them refusing to honor the warranty due to a previous repair and that the dealership won't honor the warranty due to it been passed 3 month warranty.
2. Then request the mailing address for the MD at Mitsubishi Holdcraft.

Once I have these two to write a letter to the MD of Mitsubishi Holdcraft stating that when I purchased the car I asked if this car came with the remainder of the manufacturer warranty which I was told yes to which that warranty is 3yrs or 60,000 and that includes paintwork.

To then state Mitsubishi decling warranty due to a previous repair is not my issue but that of the dealership who sold me the car as when the car was sold to myself I was lead to believe it was covered by the remainder of the manufacturer warranty and I was not informed about any previous repairs that would void my warranty on the paint.

I shall then go on to say its a disgrace that the service manager at Mitsubishi Holdcraft is trying to fob me off with a 3 month warranty excuse which is a clear breach of the sales of good act and is something I shall be informing my solicitor and trading standards about if this is not resolved to my satisfaction.

So based on the fact when I was sold the car I was informed it had the full remainder of manufacturer warranty means Mitsubishi themselves were not aware of any paint defect and as such sold the car with a full warranty and warranty was invalidated at my purchase. So refusing to warrant something that should last a minimum of 3yrs to satisfactory quality also means this car was mis-sold to myself.

The car is less than 3yrs old, a previous repair has been made to the car which Mitsubishi may or may not be aware off and that job was not done to a satisfactory quality and was before I took ownership. I was sold the car under the pretense it had a full remainder of manufacturer warranty and now Mitsubishi are trying to back out of this and so is the dealership. Its upto someone to rectify this issue and resolve this for myself whether that be the dealership or Mitsubishi themselves or otherwise I've not only been sold a car of un-satisfactory quality I was infact mis-sold the car.

I'd rather this stop here and we can come to some kind of agreement and get my car fixed please, if not then I shall have to request my solicitor shall be communicating with yourself and trading standards.




Your thoughts on that letter guys?

I've also tracked down previous owner, he is on holiday but back next week and gonna call him then and ask if he had any paint work to the arch done by Mitsubshi or a 3rd party.
 
Sounds good. What's the bet on them buckling and doing the right thing?

I'd still send a letter of complaint though, they must fob off a lot of people who probably say nothing.
 
Before getting to the letter writing stage have you been in and spoken to the dealer principle? Might be worth setting up a meeting to see him and make them aware before hand what your going in to discuss. If you get no luck then escalate to the MD
 
1. Put it in writing. With both your complaint and what you want them to do.
2. Speak to the dealer principle
3. Raise a complaint with Mitsubishi uk (the distributor and who dishes out the brand franchise)

Your main issue is that you bought the car on the premise of a manufacturer's warranty, which they're telling you is now not valid.

Secondly, if the warranty is not valid, then irrespective of this you still have rights under the Sale of Goods Act that anything you buy from a business should be reasonably free from defect and fit for purpose ("of satisfactor quality"). Paint peeling on a car which is 2 years old does not count as satisfactory. They have a statutory obligation to rectify this under the sale of goods act.

Last, but not least - your final remedy for the situation is to seek recompense through the small claims court.
 
I rang the dealer principle on lunch, he is coming to visit me at work tomorrow and inspect the car for himself.

So maybe I am getting somewhere. :)
 
good news :) keep us updated.

Remember to stress the key point - you bought the car from a mitsubishi franchised dealer for the warranty and assurance that goes with buying a franchised dealer used car. You did not expect to buy one only to be told it had its paintwork warranty invalidated and you werent told this at the point of sale, otherwise you'd have looked elsewhere.
 
daft question but has it deffo has a repair?

know anyone with a paint depth guage that could confirm if the car has indeed had paintwork?

Reason I ask is I saw one the other day with the reg GT56 MUS (I think, was something like that) and I'm sure someone I've seen that car on either this forum or at one of Gibbo's previous employers.

Overall now a happy customer. :)

Make sure you turn everything off, and I mean everything. With anything on it feels dull and lifeless. On Sport+ and the traction control, and stability control turned off, it feels much much better.
