'New' EK block very scratched

If you have to click on a Small box that says "i have read and agree to the terms and conditions" when you placed a order, your seven days could have all ready started or you may have wavered some of you rights.

That sounds like absolute rubbish to me. Statutory rightts are not affected by a tick box surely.

They shouldn't be.

The court will definitely not see it in the companies favour and most of the time a company wouldn't contest a court hearing because that would cost more than the item,in question.

£50 block 500 costs to send someone to court to dispute it
 
He even quotes a bit where it says "the right is unconditional", his whole quote contradicts what he adds at the bottom tbh. Mind you, he does say he is still trying to get his head round it.
 
isnt that the rubber spacer though? If its rubber it will always be like that. You should have 1 rubber and 1 metal backplate.

I would just contact who ever you bought it from (reading the link the company you bought it from are very helpful) If they cant do much for you a new base is like €14 direct from EK. I know its more money but if thats your last option then its better than splashing another £55!
 
Yes its the rubber one for AMD and socket 775 which I have no use for. Looks used to me though, especially the imprints from the metal bracket on the top 4 edges. Metal one has some signs of use also.

The link in original post is not mine, somebody else seems to have been sold a new block just like mine. I didn't buy it from there.

Having checked the block there is no warranty sticker so it has definitely been opened before.

In that case i would remove it from your computer and ship it back. I wouldn't be happy if i was sent that. Also you asked how to drain your loop i would recommend putting a T in the lowest point with a blank in 1 hole then in the future its easy to drain.

Cheers, can I ask you some other things too :) When mounting a rad at the top of a case which side should the fans be put on and should they be intake or exhaust, assuming I was using 2 fans on a 240 rad. What type of screws do I need if I was to attach the rad directly to the top of the case, the ones that came with it are all long so they have to go through a fan first.
 
Well my 360 rad on the roof is mounted with the fans on top pulling out as i found in the past when i used them as intakes the amount of dusts they pulled in was a joke. I have 3 GT 1850's and temps didn't change

For the types of screws.. if its an XSPC rad it will probably be 6-32 threads but different manufacturers use different threads. For Example Danger Dens Black Ice range are M4 threaded So ull have to find out what screw threads to get and buy some longer ones as the ones that come with the radiators are cut for direct fan mounting but if you have case metal in between they usually are too short. (but check first they might be long enough to catch the thread!
 
Aquatuning have replied to me about the RMA... doesn't look like this will be simple

They first said that the block is new has no signs of use and will return it to me as is. I said that's not good enough then they say that I opened the seal on box so they can only refund 75 percent.

I have wasted the coolant from my order, paid 12 euro delivery back to them, only offering 75 percent back, must buy more coolant + delivery for that too.

I should have just kept the thing :( Looks like I'm going to end up loosing money and not even get a replacement
 
I would continue to argue with them over this, the seal was broken on the box itself and the block was in what looked to be a used state. Don't fold yet...

I then told them not to send it back, this was their reply

1. We send the item back to you

2. You can received a credit about 75%"

i still have to work things out with Aquatuning but this definitely makes things easier as I don't feel like I'm loosing so much money :D

That is awful. Under distance selling regulations you are entitled to return it at your cost for a full refund if you are not satisfied by applying to the company in writing within 7 days + 1 since recieving the item (the day after you received the item is the first day of the 7).

Personally Did you pay buy Credit Card? If so contact them and get the money back that way.
 
EU sales of good regulations are more stringent than the UK's but you would have a hard time proving that it isn't fit for purpose even though it's scratched.

Can you file a claim in the small claims court? If you can't do that then I would make sure you put a review up on review center explaining your frustations. Also Tweeting and FB commenting about them is a pretty good way to get your way.

Twitter if they have one will drive them mad. As once tweeted it can't be deleted (by them) So anyone who follows them will see it and how they deal with it.

Accept that refund at the last possible stage. As soon as you accept it I believe you are screwed for good.
 
The product is advertised with a mirror shine, it didn't come with it. Whether or not that alters the performance that doesn't matter does it? The item he received was not in the condition he that was advertised. If I got my EK block and it was like that I would have done the same. If we blow this up a bit, you don't buy a brand new "shiny" car and expect to have it come covered with mud and scratches. Surely that means they didn't for fill their end of the contract?

I thought that would have been good enough, They're probably just being stubborn as they know it won't effect performance and hoping you will bow down. I'm sure people will say "threaten them with trading standards" but I don't think that will get you anywhere.

Edit: They apparently do have a twitter page... oh really
