New HDDs + courier + wall

GRRR, just got this email from them:

Hi, any physical damage has to be reported within 48 hours of signed for the goods, unfortunately we would be unable to replace or refund the items as the damage has not been reported within time.

That's pretty annoying - i wasn't around when they delivered (they were left with a neighbour). I'm pretty sure that 48 hour thing is rubbish.....

Send them back under Distance selling regulations as stated earlier.
Companies who trade mail order have to accept the goods back within 7 days.

Distance Selling Regulations
If you sell goods or services to consumers by:

the internet
digital television
mail order, including catalogue shopping
phone
fax
then you need to know about the Consumer Protection (Distance Selling) Regulations 2000.

The key features of the regulations are:

you must give consumers clear information including details of the goods or services offered, delivery arrangements and payment, the supplier's details and the consumer's cancellation right before they buy (known as prior information)
you must also provide this information in writing
the consumer has a cooling-off period of seven working days.

How were they outer packaged i.e. box or express bag?

Could you tell there was any damage to the packaging before you opened them?

If you could then your neighbour should have signed for them as damaged packaging.

If not then they could not expect you to check for damage until they were opened, in which case claiming under DSR should not be a problem.

DSR state :

3.23 Where the DSRs give consumers the right to cancel an order, this
right is unconditional and begins from the moment the contract is
concluded. Unlike when buying from a shop, the first time that a
consumer will typically have an opportunity to examine goods
purchased by distance means is when they receive them. The DSRs
give consumers who buy by distance means more rights than
consumers who shop in person. When a distance consumer cancels a
contract to which the cancellation provisions apply they are entitled to
a refund of any money they have paid in relation to the contract even
if the goods are not defective in any way.

I would try DSR first.

If you are still unhappy and want to take it further contact citizens advice and see what they say.
 
DSR goes by when you physically get the item, not when it was shipped, so go by the date u got them.

And even then you only have to inform the place u bought from that u are returning under DSR within that 7days, dos'nt mean they have to have it back within that time frame.
 
Don't bother seeing what they say, just request a return under DSR, don't mention the damage or anything, you don't have to.

As far as you are concerned you've just changed your mind and want a refund.

Make sure they are well packaged for their return trip.

I am sooooo ****** off right now. The drive won't even spin up properly, so it's not like i'm even being "cautious" this time - the drive is totally knackered.

Well ive been using these people for years and have never had a problem :(

The drive was packed fine (plenty of bubble wrap) which suggests to me that it's them themsevles that are treating the drives like crap....

Le sigh

I'm not 100% sure the drive is actually dead... although the fact that it constantly "pings" once it's powered up.... isn't a good thing lol
 
That's still pretty badly damaged, I doubt even if you dropped the drive from 1m onto the ground it would crack the metal casing like that...

If it was me, I would send them both back (I would assume both have had the same treatment), and order from somewhere else.
 
You should edit your first post because i wrongly assumed you ordered from here and i'm sure i'm not the only one. Looks like some clumsy storeman dropped em but posted them anyway to avoid getting into trouble.
