Right im Gobsmacked... First letter i open today morning, and it's from Greater Manchester Police.

Dear Sir/Madam

Vehicle Registration Number ####### Nissan

In accordance with section 1 of the Road Traffic Offenders Act 1988, i hearby give you notice that it is intended to take proceedings against the driver of the above motor vechicle ####### Recorded Speed 42 mph

For the alleged offence of - Excess Speed (30 MPH)

at - 22:19 on 21/10/2010

at (place) - A6 Wellington Road North, JCT Heaton Lane, Stockport

contrary to Section - S81(1)RTRA 84 Sch 2 RTOA 88



:D - What it does say on the letter that they have contacted DVLA, and DVLA can't give any recent information and so on. :(:(

At the time of offence 22:19 i was at work. So no chance of me driving the car. I can get HR to write a staement/letter of confirmation. :(
I also have the DVLA Acknowledgement Letter to confirm that I am no longer the Registered Keeper.:(

Should i acknowledge the letter or what? First time ever i'v recieved a letter like this. so dont know proceedings/outcomes etc..

Fill in the details of who you beleive the driver to be and send it back, as it tells you to do. The driver being the guy you sold it to?

Problem is i dont know the person address. I know him by face. As he is a little Trader. So yea the car was sold as a Trade not a private sale.
Sold the car of to him when my Micra died on me. wasn't worth much.
He took it of me for a little price knowing what he was gona do with it ( Fix and sell again)

Did you not fill in the V5 with his details?

fill in as many details as you can on the owners section. Just give the address of the trader you sold it to, and enclose a covering letter explaining what happened and who you sold it to and a copy of your receipt from the DVLA

Explain in the letter you dont know who the vehicle owner is, as due to data protection the trader you sold it to wont disclose the name + address details of the person he sold the car to, to you (which they wont, or at least shouldnt)

combined with the DVLA letter saying you no longer owned the car, what should then happen is they go after the person who owns that car dealership, who will then just give the details of the person who bought it.

I had a parking ticket from my old VXR from manchester council and did exactly the above. Never heard no more about it.
 
I wouldn't put details of the the person you sold it to. You don't know they were driving. Simply say you don't know, say when you sold it and send a copy of the letter saying you are no longer the registered keeper.

You could just attach a letter explaining who you sold it to and proof from the DVLA and leave it at that.

Either way they are going to have to make some more enquiries so whether you write something in that box with the person you believe to be driving doesnt matter.
 
These instances are easily dealt with, simply send a letter in explaining everything in detail with as much information as you can supply, photocopies, reciepts, times and then go from there.

Thanks for the info.

Can't ring up Cop shop till Monday morning. I'v managed to get hold of the person who i sold it too. and he has sold the car through Auction 2 weeks ago.

Few of my mates have said the same thing, Dont have any obligation to do anything as it's easy for them to find out as they can contact DVLA.

just put all that in a letter and return it to the address they ask you to along with a copy of your letter from DVLA

whats worrying is that the DVLA gave you as the owner of the car at the time, was the car sold quite recently ? they may not have updated their records yet.

After all, if the DVLA records had been up to date, they wouldnt have sent you the letter in the first place, they'd have sent it to him.

Well, car broke down on me Sept 8th 2010. After finding out, it wasn't worth repairing it. So i sold it of on the 14th Sept 2010. I then recieved the letter from DVLA of confirmation that i am no longer the registered keeper. Which is dated on 22/23 Sept 2010.


The car i sold off too, he has sold it off through Auction 2 weeks ago. So can't give a exact date.

So DVLA have enough time to update reccords etc. Lazy bunch of *****.

You have nothing to worry about Sho.

You have the letter proving you are no longer the owner and your HR department can confirm that you were at work at the time.

Just make sure that you make GMP aware of this and this will be sorted.

Also, just to pre-empt the anti-police popular front here, be aware that the police may not like you escaping justice so you should be prepared to be beaten senseless, tasered and have heroin and assault rifles planted on you.
