Parking Fine.

Only the crown (Council/Police) can issue fines, other companies can only issue invoices.

You will see that the ticket is call a Penalty Charge, and not a Parking Fine. A company has not authority to issue "fines" on the general public. They can however take you to Court over the loss of profit because of your over stay....the lost of profit in this instance may be the shopping of 1 other car so the profit would be the shopping profit for them in this period.

Besides, they also need to know who was driving as the Defendant need to be named if they do sue.

They never do, it is not costs effective. Hence the scare tactics.

Surely only if they could actually prove the car park was completely full though?

It's impossible to have denied them custom if there were still other spaces available anyway.

Theoretically yes, although to be honest you'd be a bit of a **** to do so, because lets face it, while parking companies are generally scum, they do provide a valuable service.

I've got no issue with paying a fair amount for parking, I do however have a major problem with companies blatant profiteering for an innocent mistake (e.g. overstaying in a free carpark by 17 mins). What part of paying £30 for that seems reasonable to you?

You could, but you'd probably soon find yourself the victim of getting clamped or something as they'd soon pick up on you doing it repeatedly.

More than happy to pay for parking where it is requested but trying to 'fine' people £30 for tiny overstays that cost them pennies at best (and that's realistically only if the car park physically cannot accommodate more cars) is taking the **** and only a mug would indulge them.

Dear Sir/Madam,

I received a parking ticket on **/**/** but I will not be paying your demand for payment as I was not the driver of the vehicle at the time in question. I am also under no obligation to disclose who was driving the car so please do not contact me again with regards this matter.

Yours Thankfully,



That letter is actually copied from the letter on moneysavingexpert. There is another letter on there to use if you continue to get letter so I might see how far this goes.
