Problems with Biostar A780L wattage limit

I built a new PC for my parents this weekend using an old Athlon X2 4000+ (rated at 65w) I used to use for my old shuttle, the motherboard it is going into is a Biostar A780L, when I booted it for the first time it said that it was shutting down as the processor was over 125w!
Any idea why it might be doing this? I have tried a bios update but I cant get to the flashing utility as it wont get past the POST, I can get to the bios and I have tried loading default settings, but this still wont work! help!
 
I have done a bit more resarch into this now, seems to be fairly widespread issue! the solution seems to be a bios update... but I cant update it without getting past the POST first it seems! :mad:

Have raised a support call with Biostar but they have not replied! (raised it on the 24th)

any ideas what I should do? is it worth sending it back to the retailer and seeing if they can send another? I suspect it will probably have the same issue!
 
Are you sure there is'nt a flash utility built into the bios. Most boards have these days?

Failing that buy a cheap secondhand cpu to flash the bios then sell the cpu on again?
